In an unprecedented move, the Shreveport City Council on Tuesday September 11, 2007 adopted and Shreveport Mayor Cedric B. Glover immediately following adoption, approved an amendment to the City of Shreveport odor ordinance. | The amendment is intended to clarify that prosecution of the violation of the ordinance, may be initiated by the City Attorney’s Office or any other appropriate authority of the City, upon determination that a violation of the ordinance has occurred or, after receipt of a written complaint by any person. | During the recently concluded 2007 regular session of the Louisiana Legislature, Mayor Glover lead the fight to adopt legislation recognizing the City’s authority, to regulate odorous air contaminants by rendering plants. | “The intent of the ordinance and this amendment is to eliminate any impediment or obstacle to enforcement across the board”, says Mayor Glover. “We have not, nor do we intend to target or single out any particular operator or operation … the ordinance will be enforced against all violators.” |
| “We recognize the right of all of our citizens, corporate or otherwise, to use and enjoy their property to its greatest economic benefit”, says Mayor Glover. “However, that right must be exercised and enjoyed in a manner that is not unlawful and does not injure, damage or inconvenience your neighbor.” | When this occurs, the City will utilize and employ all legal remedies at its disposal to abate the violation, including but not limited to, instituting legal action against the violator. | The amendment becomes effective Wednesday, September 19, 2007. Until then, the City of Shreveport will continue to prosecute violations under the current order. |
