RESOLUTION NO. ____ OF 2011
A RESOLUTION TO REQUIRE THE CHIEF ADMINISTRATIVE OFFICER, TO OFFER THE FAIR MARKET VALUE (AND IF ACCEPTED) TO PURCHASE THE FLOOD PRONE PROPERTIES LOCATED AT 8035 AND 8037 JEWELLA AVENUE BY OCTOBER 26, 2011, OR TO PROVIDE A REPORT TO THE COUNCIL RELATIVE TO THIS MATTER ON THAT DATE AND TO OTHERWISE PROVIDING WITH RESPECT THERETO

WHEREAS, Charles R. Duke, the owner of the buildings located at municipal addresses 8035 and 8037 Jewella Avenue, Shreveport, has appeared before the Council on several occasions to request that his flood prone properties located at 8035 and 8037 Jewella Avenue be purchased by the City; and
WHEREAS, on September 14, 2010, Mr. Duke appeared before the Council and the Director of DOS stated that Mr. Duke’s properties were on the City’s Flood Prone Property list as early as 1996, essentially agreeing with Mr. Duke’s assertion that his properties should be purchased; and the Director of DOS did not disagree with Mr. Webb’s assertion that Mr. Duke’s properties should be first on the list of properties to be purchased; and
WHEREAS, the request of Mr. Duke illustrated the need for additional funds to acquire flood prone properties to reduce loss and improve drainage, and was a factor in the decision to include funds for that purpose in a Bond Issue Proposition; and
WHEREAS, Mr. Duke has made application to the City to purchase his properties; and
WHEREAS, the Capital Project styled, “Purchase Flood Prone Properties” has been established and funded with 2011 Bond Funds; and
WHEREAS, Mr. Duke’s request should be processed and the property purchased unless the City’s reasonable offer is rejected.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Shreveport in due, legal and regular session convened that the Chief Administrative Officer, is required to offer the fair market value (and if accepted) to purchase the flood prone properties located at 8035 and 8037 Jewella Avenue by October 26, 2011, or to provide a report to the council relative to this matter on that date
BE IT FURTHER RESOLVED that if any provision of the Resolution or the application thereof is held invalid, such invalidity shall not effect other provisions, items or applications of this Resolution which can be given effect without the invalid provisions, items or applications, and to this end the provisions of this Resolution are hereby declared severable.
BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.
