FACT SHEET ______________________________________________________________________________ TITLE DATE ORIGNATING DEPARTMENT AN ORDINANCE DECEMBER 27, 2011 COMMUNITY DEVELOPMENT DECLARING CERTAIN CITY-OWNED PROPERTY TO BE SURPLUS PROPERTY; AUTHORIZING THE DONATION OF THE PROPERTY TO THE FULLER CENTER FOR HOUSING OF NORTHWEST LOUISIANA, INC.; AND TO SPONSOR OTHERWISE PROVIDE WITH RESPECT THERETO. SAME ______________________________________________________________________________ PURPOSE To declare 1516 Clay Street and 1520 Clay Street as surplus property and to authorize the donation of the property to The Fuller Center for Housing of Northwest Louisiana, Inc. ______________________________________________________________________________ BACKGROUND INFORMATION By authority of Resolution Number 53 of 2003, the City purchased a number of properties from the United States Department of Housing and Urban Development (“HUD”) for the sum of $10.00 and other valuable consideration. As a part of the consideration for the sale, all property acquired by the City in the transaction was to be redeveloped to provide affordable housing or other appropriate neighborhood revitalization uses as determined by the City and approved by HUD. All property acquired in the 2003 transaction with HUD was to ultimately be conveyed to qualified individuals or organizations for authorized uses in accordance with deed restrictions imposed by HUD and a Memorandum of Understanding (“MOU”) between the City, HUD, and the State of Louisiana Historic Preservation Officer (“SHPO”). 1516 Clay Street and 1520 Clay Street were acquired by the City as a part of the 2003 transaction with HUD. Neither property is needed by the City for public purposes. The City desires to donate 1516 Clay Street and 1520 Clay Street to The Fuller Center for Housing of Northwest Louisiana, Inc. subject to the terms and conditions contained in the attached Act of Donation. This ordinance would declare 1516 Clay Street and 1520 Clay Street to be surplus property; authorize the donation of the property to The Fuller Center for Housing of Northwest Louisiana, Inc.; and, authorize the Mayor to execute any/all documents relative to the donation. ______________________________________________________________________________ TIMETABLE Introduction - December 27, 2011 Final Passage - January 24, 2012 SPECIAL PROCEDURAL REQUIREMENTS LSA-R.S. 33:4712 requires that notice of this ordinance be published at least three times within fifteen (15) days, one week apart. ______________________________________________________________________________ FINANCES None ______________________________________________________________________________ ALTERNATIVE 1. Jenkins WHEREAS, the City of Shreveport, through the Department of Community Development, has acquired title to certain property identified as 1516 Clay Street, Shreveport, Caddo Parish, Louisiana and 1520 Clay Street, Shreveport, Caddo Parish, Louisiana, from the United States Department of Housing and Urban Development (“HUD”); and WHEREAS, the said properties were formerly part of HUD’s SNAP II inventory and were acquired by the City with the intent, and subject to the condition that they ultimately be conveyed to qualified individuals or organization for authorized uses in accordance with deed restrictions imposed by HUD and a Memorandum of Understanding (“MOU”) between the City, HUD, and the State of Louisiana Historic Preservation Officer (“SHPO”) relative to City’s acquisition of the said property from HUD; and WHEREAS, The Fuller Center for Housing of Northwest Louisiana, Inc. (“Fuller Center”), a duly organized 501 (c)(3) organization, is engaged in an aggressive plan for redevelopment and revitalization of certain areas within the Allendale neighborhood; and WHEREAS, in furtherance of its plan, the Fuller Center has constructed a total of forty-two (42) homes to date in the Allendale neighborhood intended to provide homeownership opportunities for low to moderate income person with plans for construction of up to eighteen (18) additional affordable single family homes in the area; and WHEREAS, the Fuller Center has requested and the City desires to donate 1516 Clay Street and 1520 Clay Street to the Fuller Center for use in the organization’s redevelopment and revitalization efforts in the Allendale neighborhood; and WHEREAS, continued redevelopment and revitalization of the Allendale neighborhood will yield a significant benefit to qualified low to moderate income persons seeking homeownership opportunities and continue improvement of a socially and economically distressed area for the benefit of all citizens of the City of Shreveport; and WHEREAS, the said property is not needed by the City for a public purpose and should therefore be declared to be surplus property; and WHEREAS, LSA-R.S. 33:4712 requires that notice of this ordinance be published at least three (3) times within fifteen (15) days, one week apart. NOW, THEREFORE BE IT ORDAINED, by the City Council of the City of Shreveport in due, regular and legal session convened, that 1516 Clay Street and 1520 Street are hereby declared to be surplus property and not needed by the City of Shreveport for a public purpose. BE IT FURTHER ORDAINED that the City of Shreveport is hereby authorized to donate 1516 Clay Street, Shreveport, Caddo Parish, Louisiana and 1520 Clay Street, Shreveport, Caddo Parish, Louisiana to The Fuller Center for Housing of Northwest Louisiana, Inc. (“Fuller Center”), in “as is” condition and without warranty of title or recourse whatsoever against the City of Shreveport, in accordance with state law, city ordinances and subject to the deed restrictions imposed by the United States Department of Housing and Urban Development (“HUD”) and the Memorandum of Understanding between the City of Shreveport, HUD and the State Historic Preservation Officer (“SHPO”) relative to City’s acquisition of the said property from HUD. BE IT FURTHER ORDAINED that the Mayor of the City of Shreveport is authorized to execute and deliver, for and on behalf of the City of Shreveport, any and all documents relative to the donation of the property to the Fuller Center after review and approval of such document(s) by the Office of the City Attorney, and to do any and all things necessary and incidental to carry out the authorization expressed in this ordinance relative to donation of the said property. BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this ordinance which can be given effect without the invalid provisions, items or applications and to this end the provisions of this ordinance are hereby declared severable.
