    December 9, 2008

    The regular meeting of the City Council of the City of Shreveport, State of Louisiana was called to order by Vice-Chairman Joyce Bowman at 3:00 p.m., Tuesday, December 9, 2008, in the Government Chambers in Government Plaza (505 Travis Street).

    Councilman Shyne: Let us all stand. Tom, let somebody pick up your name plate there because I want everybody to - - -

      Mr. Dark: I don’t have a name plate Mr. Shyne.

      Councilman Long: They didn’t make him one.

      Councilman Shyne: Well what was that that fell on the ground?

      Councilwoman Bowman: Come on and pray Councilman.

      Councilman Shyne: Well, lets bow our heads then.

      Invocation was given by Councilman Shyne.

      The Pledge of Allegiance was led by Councilman Walford.

    Councilman Shyne: My prayer was short, so the meeting will be what? Nice and short.

    Motion by Councilman Shyne, seconded by Councilman Long to approve the minutes of the Administrative Conference, Monday, November 24, 2008 and Council Meeting, Tuesday, November 25, 2008.     Councilwoman Bowman: Before I come to you Dale, I have one and that is LaTonya “Tonya” Bogan was born on December 13, 1974 to the proud parents of Arthur & Barbara Bogan both from Mansfield, La. Tonya native of Shreveport, La graduated in 1992 from Fair Park High School and received her Bachelor of Science degree in Computer Information System from Grambling State University in 1997. Tonya is the proud mother of two lovely girls, Jasmin & Keyarah Samuels, Tonya is currently an employee of the Shreveport in the City Council office where she brings joy to all around her. And we all do dearly love her. Happy Birthday Tonya, and she’s in the control room.

    Awards and recognition of distinguished guests by the Mayor, not to exceed fifteen minutes.

    Mr. Sibley: Thank you Madam Chairman. We do have one presentation. I’m going to call on Mrs. Moore to come forward and I think Rick went up to get the item, but Ms. Moore has a presentation to make to the Council, so we’re going to call on her today.

    Ms. Moore: Good evening. First of all, I’d like to say thank you so much for providing the funding necessary for us to complete the process for NIP. It is extremely important that they get the contracts within the first quarter. Many times their projects start in January and February, particularly those that deal with the school board. The school ends in June, and quite often contracts, where there’s not time to get to them in May and June of each year, and so I truly appreciate you for that. I’m standing here today because we’re about to complete the fifth year of NIP. It has been a wonderful program and it could not have happened without the support of the Council. Particularly the leadership of Councilman Lester, whose vision it was to start the Neighborhood Investment Program. The support of the previous Council and the continued support of this Council. We have funded over 41 agencies, and we have completed over 153 projects. These projects were not available before NIP, before NIP the agencies did not have the capacity or the resources to be able to do this. And so on behalf of the NIP participants, we have a plaque for you. And I want to read the plaque to you and all of the NIP participants were excited about the NIP program, they continue to be excited about it, they have done some wonderful things. We also want to acknowledge the administration. If it was not for the administration allowing us to assist in administering this program, we too think that it would not have been a success. So it reads: This special service award is presented to the Shreveport City Council for the development and implementation of the Neighborhood Investment Program. The Resolution No. 94 of 2003, authored by Councilman Calvin Ben Lester, Jr., District A. Presented by the Department of Community Development and all of the NIP recipients.     Councilwoman Bowman: How about letting Calvin come down and receive that.

    Ms. Moore: It was our intent to give this at the NIP reception, but Councilman Walford and Lester, both left before we were able to give it to them, but we appreciate you coming though.

    Councilman Lester: It was bath time.

    Councilman Shyne: Calvin, just a minute, let the photographer from the Shreveport Times come up and take y’all’s picture.

    Councilman Lester: No, no. Thank you.

    Mr. Sibley: Thank you Madam Chairman.

    Councilwoman Bowman: Thank you. Is that all you had?

    Mr. Sibley: That’s it.

    Communications of the Mayor relative to city business other than awards and recognition of distinguished guests.

    Councilwoman Bowman: Since I have the privilege of being Mayor Pro Tem, I was taking requests from anybody who gave me request basically, and one request I had other than Tonya’s birthday, was Sheriff Steve Prator in the parking lot said that we needed to have the $10 lap dance sign removed from Deja Vu, it’s quite tacky. And will someone give them a call and let them know that the Mayor for today requested that they take that tacky sign down. Thank you.

    Reports: Property Standards Report

    Mr. Holt: The only report I have is for Councilman Long, he’s already got it, and he’s busy delivering flowers. So, if you have any other requests, I’ll be glad to take them.

    Councilman Shyne: Just tell Councilman Long since he’s delivering flowers, he can bring me a pomegranate for Christmas.

    Mr. Holt: I’ll tell him that.

    Public Hearing: Proposed 2009 Downtown Development District Budget, appropriating the funds authorized therein, and otherwise providing with respect thereto.

    Councilwoman Bowman: The public hearing is now open. Is there a presentation from the Administration?

    Mr. Dark: Just a very brief one Madam Mayor Pro Tem. This is a legal requirement that has to be met before any operating budget can be passed. We held the public hearing on all the other operating budgets a couple of weeks ago, so this one is on Ordinance No. 162, which is the DDA Budget. It’s approximately $1.7 (million) for operations, and another $1.7 (million) for Capital Improvements. Mr. Shea, the Executive Director is here if anyone has any questions for him, or if he wants to make a presentation.

    Councilwoman Bowman: Mr. Shea?

    Mr. Shea: I covered what I needed to cover during the workshop.

    Councilwoman Bowman: Do we have anyone here to speak in favor of the Downtown Development District Budget ordinance? Does anyone wish to speak in opposition to the Downtown Development District Budget ordinance? If not then this public hearing is now closed.

    Adding Items to the Agenda, Public Comments, Confirmations and Appointments.

    Adding Items to the Agenda (Clerk reads items into the record - public comments allowed on items proposed to be added, then items can be added only after unanimous vote [ See Act 131 of 2008])

    The Clerk read the following:

    1. Resolution No. 274 of 2008: A Resolution authorizing the receipt of a grant from the Louisiana Housing Finance Agency; authorizing the execution of contracts, documents and instruments on behalf of the City of Shreveport relative to receipt and disbursal of the funds; authorizing disbursal of the proceeds of the funds to or on behalf of qualifying first time homebuyers; and to otherwise provide with respect thereto.

    2. Ordinance No. 176 of 2008: An ordinance authorizing the lease of City owned property located at 601 Benton Kelly Drive to MB Industries, L.L.C., and to otherwise provide with respect thereto. (D/Wooley)

    Mr. Thompson: I believe that there is a provision in the Act 131 of 2008 that states that we’re supposed to state why they’re being added. Tom, do you want to add any comments to either or both of these?

    Mr. Dark: I’d be happy to Mr. Thompson. The City has recently received the Housing and Financing Agency Grant, and the reason this is on the agenda is that we can’t proceed with actually accepting it, unless the Council adopts this resolution at some point. And the other one, the leasing City Property to MB Industries is a three-reader because of advertising requirements, it can’t be passed until the first Council Meeting in January. We’re hopeful to have all the negotiations worked out between now and then. And this is being introduced to give us a head start.

    Councilman Shyne: So moved Madam Chairman.

    Mr. Thompson: Mr. Shyne, not quite. Act 131 of 2008 also provides that the Council must provide an opportunity for Public Comments before either of these items are added. You may want to ask if anybody wants to comment Pro or Con as it relates to these.

    Councilwoman Bowman: Do we have anyone here in favor of adding this to the agenda? Do we have anyone here to speak in opposition?

    Councilman Shyne: So moved again Madam Chairman, we’ve dotted all “I(s)” and crossed all “T(s)”.

    Public Comments (Comments on items to be adopted)

    Mr. Darrell Norberg: (535 Applespice Dr) Madam Mayor, Ladies and Gentlemen, Tom, we’re going to miss you.

    Mr. Dark: Thank you.

    Mr. Norberg: I’d like to speak to the proposal about changing water rates for commercial water rates. This is just a point of information. There are residences in this city that are on commercial rates. We have master meters, and the water distribution is taken care of by the homeowners, not by the city. So, we’re given a commercial rate for that water, because there is very little cost to the city other than for the water. And I do know that Apple Tree Home Association, I’m the president and represent 141 residents there, we would like to recommend that you consider that fact and maybe possibly amending this proposal so that you can address that situation. It’s kind of unusual for the city to approve a water rate, when it’s really not for water, it’s for the budget that seems out of place. But anyway (inaudible) request. Thank you very much.

    WHEREAS, Act 554 of 1978, which authorized the creation of the Downtown Development Authority, requires that a formal Program of Work for the DDA be adopted annually by the City Council; and

    WHEREAS, the DDA has prepared and formally adopted its Program of Work for the year 2009 and recommended its approval by the City Council.

    WHEREAS, the City Council adopted Ordinance No. 151 of 2008, which established a City Travel Policy, and;

    WHEREAS, Ordinance No. 151 of 2008 required that the Chief Administrative Officer prepare a detailed Travel Policy to implement the provisions of said ordinance and to submit it to the City Council for approval by December 8, 2008.

    NOW, THEREFORE BR IT RESOLVED by the City Council of the City of Shreveport in legal session convened, that it hereby acknowledges receipt of the Travel Policies and Procedures prepared by the Chief Administrative Officer and approves said document, effective January 1, 2009.

    Councilman Walford: Just very briefly, the question I had yesterday, that was under your penalties with the 30 days, it didn’t conflict with the travel card policy. So, in fact, I am very glad to see that you put that in there. I commend you on the job you did on that Mr. Dark. Thank you.

    Councilman Shyne: And Councilman Walford, it’s very seldom you put me in a position where I can commend you on some legislation. And I’d like to commend you on an excellent piece of legislation. It will bring this Council up to date when it comes to our travel policy, and I want to thank you for that. I don’t know how you got the idea, but it’s a great idea. I don’t know whether Councilman Lester gave it to you, or whether it was something that you came up with on your own, but it was a great idea.

    Councilman Wooley: Just for the benefit of the Council, I’d like to ask Mr. Westmoreland to come up to explain the de-annexation. I know there was some question about that yesterday. I know it’s only for introduction, but that way you can hear the information, and that gives you time.

    Mr. Westmoreland: Madam Chairman, Members of the Council, I’m here on behalf of my client, Dr. Blair Drummond and his wife Erin Drummond. What we’re asking for here is a de-annexation of a simple 1.15 acre tract of land. If you look at this plat, Dr. Drummond owns this property that is 1.4 acres, he also owns this property here. The part that we’re seeking to de-annex is this 1.15 acre tract right here. He is currently finishing up a home in Southern Trace on a 4 acre lot. It’s going to be a considerable property with improvements. We had annexed the 1.15 a while ago thinking that it was needed, the development of that lot, in fact it is not. We’re asking for the de-annexation simply because what it does, it chops these up, one piece of his land in the city, one piece out of the city. And simply creating this 4 acre lot that will be in the city will be subject to Parish and City taxes. And a very sizeable home being built on it, so I guess my point in bringing that up is tax dollars that will be accumulated from the lot, one are going to be considerable. And simply to remove 1.15 acre tract there from the City limits so that all of this can remain together as one piece. It can also be assessed as one piece. You don’t have a part of the property in the city limits, part of the property out of the city limits. And he’s simply trying to get all his property just kind of good and straight so in his words, his wife won’t have to deal with it if anything happened to him. So, that’s why we’re here today, and we’ll entertain any questions. I appreciate Councilman Wooley listening to my ramblings and understanding what we’re trying to do here.

    Councilman Walford: Wouldn’t it be more advantageous to the City to annex the other instead of de-annexing the one that’s already in the city?

    Mr. Westmoreland: Perhaps, the problem is we don’t know what’s going to happen with that other piece. I mean it’s not really up for sale, it’s just being held, it’s timber property. So, perhaps it would be more advantageous to the city, but he doesn’t really know what he’s going to do with that piece of property, he doesn’t have any current plans for it.

    Councilman Walford: But if we’re just trying to be consistent with the two pieces of property, it would look to me like it would be much better for the city. I see heads nodding over there, so somebody agrees with me. Thank you.

    Mr. Westmoreland: Well I understand your point, but I’d like to re-emphasize again the tax dollars that are going to be generated on this 4.48 acre lot with the home are going to be considerable, I mean in excess of $500,000 value. And so when we’re looking at a 1 acre tract versus the improved tract that has been built and will soon be online for taxes for the city, I think you’re much better off with the 4 acre lot with a nice home on it. I appreciate your time, thank you.

    Councilman Long: Mike, you and I’ve talked about this before, but for the benefit of the folks here, there are several communities in my district and Councilman Wooley has several in his district that are essentially residential properties. What’s the argument or logic to charge them a business rate, versus a residential rate?

    Mr. Strong: Well, this would be similar to what you would see in a commercial or an industrial business. They didn’t have the numerous lines on the inside of their facility, like you would have with this facility. And it’s operated as a residential subdivision, but they do it with a single meter versus having the meters that we actually go and read individually.

    Councilman Long: But in a sense, wouldn’t that be less cost to us from a monitoring standpoint, having just one meter to read or to deal with relative to all that?

    Mr. Strong: That’s what I said. This is similar to commercial and industrial. So the answer is by bringing it all up to one fee, which is done in other cities is what we’re doing. So to say that it’s less costly, the answer is yeah, we do not maintain the lines on the inside of a commercial facility or on the inside of this facility.

    Councilman Long: Alright so, am I hearing that other cities do the same thing for their residential developments of this nature? Meaning that they charge a business rate versus a residential rate? And the other question is what is the main difference between the residential rate and the business rate in this scenario?

    Mr. Strong: Let me see if I brought the fees out. I’d given you all a chart.

    Councilman Long: I know, and I apologize.

    Mr. Strong: It’s been on there, because what they’re charging right now on the residential water rate is $2.70. And I was saying that the commercial is $2.37 per thousand gallon. So that would be the difference. It would go from $2.37 up to the $2.70.

    Councilman Long: And residential stay down to $2.39?

    Mr. Strong: Pardon?

    Councilman Long: I’m looking at the rates here. It says that the residential stays at the $2.39, or does it go up to $2.70 as well?

    Mr. Strong: It goes up to $2.70.

    Councilman Long: So essentially the same rate. Is that what I’m hearing? The business and the residential is the same?

    Mr. Strong: No sir, it will be under the new - - -

    Councilman Long: I know. Now it’s not, but it will be - - -

    Mr. Strong: That is correct. It will be $2.70 for the water.

    Councilman Long: Okay, so everybody pays $2.70.

    Mr. Strong: And be under that new program.

    Councilman Long: And the differences where we have them, is one of the changes as part of this proposed rate structure, is just that of the minimal billing that some people were experiencing in the past?

    Mr. Strong: That goes to the residential side of where if a resident right now, that if it’s under a thousand gallons, they would get a flat rate. Now, if it’s 3,000 gallons or less, it would be a flat rate.

    Councilman Wooley: Question. Someone who is not a resident, and does not live in a community where one meter reads all, what is their rate going to be?

    Mr. Strong: The same as it is now, $2.70.

    Councilman Wooley: So every resident will pay $2.70 across the board in the City of Shreveport if we do this?

    Mr. Strong: Residents right now, yes sir. You would pay $2.70 per thousand gallon.

    Councilman Long: Well I’m reading the ordinance here, and under Section 94-165, paragraph 2, Quantity charge, calculation the user change portion on the customer class is $2.39. Now that’s effective January 1, 2009, what does that relate to? No, that’s the sewer charge.

    Mr. Strong: Yes, you’re getting into the sewer now. Now if you come over to the sewer, look at the user charge and the (inaudible) charge, and you come up to $3.58 for the sewer quantity charge.

    Councilman Long: Right, okay. So essentially, it looks like it’s going to normalize this whole thing across the board is what it looks like to me.

    Mr. Strong: That’s what it’s set up for.

    Mr. Dark: Madam Chair, the one thing that I think I probably ought to point out is if you live in an apartment complex, then you’re paying commercial rates already.

    Mr. Strong: Correct.

    Mr. Dark: That the advantage is if you live in a - - - like an Appletree, a homeowner group where everybody owns their home, you were paid a different rate perhaps than for the other folk.

    Councilman Long: Will they be charged the old rate at the lower residential rate? Were these homeowner associations being charged at a lower rate?

    Mr. Strong: They were being charged a commercial rate, same as an apartment would be.

    ORDINANCE NO. 163 OF 2008

    AN ORDINANCE TO AMEND CHAPTER 2, ARTICLE IV OF THE CITY OF SHREVEPORT CODE OF ORDINANCES TO ENACT DIVISION 12 RELATIVE TO THE CREATION AND ESTABLISHMENT OF THE DEPARTMENT OF PROPERTY STANDARDS AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    WHEREAS, pursuant to authority contained in Section 8.02 (c) of the Charter, the Administration has studied the needs and requirements of the City with regard to the efficient and effective administration of property standards within the City of Shreveport; and

    WHEREAS, pursuant to Section 4.20 of the Charter, the City Council is authorized to create and establish new departments to administer functions not established by the Charter; and

    WHEREAS, the creation of the Department of Property Standards will allow for the consolidation of functions and duties into a single department and provide for consistency in the administration and enforcement the Property Standards ordinance thereby resulting in the reduction or elimination of a greater number of deteriorating residential, non-residential, and other premises which are detrimental to the health, safety and welfare of the general public.

    NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Shreveport, in due, legal and regular session convened that Chapter 2, Article VI of the City of Shreveport Code of Ordinances is hereby amended to enact Division 12 to read as follows:

    Sec. 2-261. Created; duties.

    (a) There is hereby created and established pursuant to Section 4.20 of the Charter, the department of property standards. The department shall consist of such bureaus or divisions as may be created by ordinance or as may be assigned to it by proper authority. Any reference to the bureau of property standards in any ordinance, resolution, law, rule, obligation, contract, grant or document besting any power in, assigning any function to, or imposing any duty upon that bureau shall be deemed to refer to the department of property standards.

    (b) The department shall be responsible for the reduction or elimination of deteriorating conditions of residential, non-residential, and other premises which are detrimental to the health, safety and welfare of the general public. The department shall also be responsible for such other duties and responsibilities as may be assigned to it by ordinance or other authority.

    Sec. 2-262. Offices created; appointments.

    (a) Unless until otherwise provided by ordinance and pursuant to Section 4.20 of the Charter, the offices of director and assistant director(s) of the department of property standards are hereby created.

    (b) The mayor shall appoint, subject to confirmation by the city council, the director of property standards. After recommendation by the director of property standards, the mayor shall also appoint assistant director(s) of property standards, subject to confirmation by the city council.

    (c ) Any reference to the Administrator of the Bureau of Property Standards in any ordinance, resolution, law, rule, obligation, contract, grant, or document vesting any power in, assigning any function to, or imposing any duty upon the Administrator of the Bureau of Property Standards shall be deemed to refer to the director of the department of Property Standards.

    Section 2-263. Duties of director.

    The director of property standard shall be the head of the department of property standards and shall have immediate direction and control of all employees in the department in accordance with the policies promulgated by the mayor or the chief administrative officer. To that end, the director shall, with the approval of the chief administrative officer:

    (1) Appoint and remove all officers and employees of the department, in accordance with the provisions of the Charter and other applicable law.

    (2) Develop and implement rules and regulations consistent with the Charter and the ordinances of the city prescribing the duties and responsibilities of all officers and employees of the department, and supervise and control their activities.

    (3) Perform the duties prescribed for the director of property standards provided by the Charter and by ordinance.

    Sec. 2-264. Transitional provision.

    When not inconsistent with the provisions of the Charter, any reference in any ordinance, resolution, law, rule, obligation, contract, grant or document vesting any power in, assigning any function to, or imposing any duty upon any office, officer, person or body abolished or reassigned by this division, shall be deemed to refer to the office, officer, person or body under this division that most closely corresponds to that designated in the Charter, Code, ordinance, resolution, law, rule, obligations, contract, grant or document.

    ORDINANCE NO. 165 OF 2008

    AN ORDINANCE TO AMEND PORTIONS OF CHAPTER 94 OF THE CODE OF ORDINANCES RELATIVE TO WATER AND SEWERAGE RATES AND TO OTHERWISE PROVIDE WITH RESPECT THERETO

    BY:

    WHEREAS, the City of Shreveport operates the water and sewerage systems which serve its citizens; and

    WHEREAS, the Mayor has recommended that the water and sewer rates for commercial and industrial customers be increased to the same as the water and sewer rates for residential customers, to be effective January 1, 2009, to provide the water and sewerage utility with adequate revenues for operations and debt service; and

    WHEREAS, the Mayor has recommended that residential customers with water consumption of 3,000 gallons or less receive a monthly minimum bill, to be effective January 1, 2009.

    NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Shreveport, in legal session convened, that Section 94-162. Section 94-164(2), and Section 94-165(2)(c) of the Code of Ordinances are hereby amended and re-enacted as follows:

    WHEREAS, the Property Management Section of the Department of Operational Services has received a request to close and abandon a portion of the 30 foot-wide dedication for Klug Pines Road, lying between Garden Oaks Drive and Westwood Road, in the Nichols Subdivision, as recorded in Book 50, Page 367, of the Conveyance Records of Caddo Parish, Louisiana, and as shown on the attached plat, and

    WHEREAS, none of the polled utility companies have expressed an objection to this closure and abandonment, and

    WHEREAS, the Office of the City Engineer has reviewed this request and has no objections to this closure and abandonment, and

    WHEREAS, this closure and abandonment was approved by the Metropolitan Planning Commission on November 5, 2008, and

    BE IT ORDAINED by the City Council of the City of Shreveport in

    legal and regular session convened that it shall hereafter be unlawful for anyone to park any

    vehicle between the hours of 7:30 am and 9:00 am Monday through Friday on either side

    of Thornhill Avenue between Kings Highway and Rutherford Street.

    AN ORDINANCE AMENDING CHAPTER 106 OF THE CODE OF ORDINANCES, THE CITY OF SHREVEPORT ZONING ORDINANCE, BY AMENDING ORDINANCE #154 OF 1996 BY REMOVING STIPULATION #3 WHICH REQUIRED A 50’ BUFFER IN A B-2-A, BUSINESS PARK DISTRICT ON PROPERTY LOCATED ON THE WEST SIDE OF PREMIER COURT, 250 FEET SOUTH OF BERT KOUNS INDUSTRIAL LOOP, SHREVEPORT, CADDO PARISH, LOUISIANA, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO

    SECTION I: BE IT ORDAINED by the City Council of the City of Shreveport, Caddo Parish, Louisiana, in due, legal and regular session convened, that stipulation #3 of Ordinance 154 of 1996 be removed for property located on the west side of Premier Court, 250 feet south of Bert Kouns Industrial Loop, legally described as Lot 3, Home and Office Storage #3, I-49 Phase II, Shreveport, Caddo, Louisiana. Said stipulation #3 of Ordinance #154 of 1996 required a 50’ buffer in a B-2-A, Business Park District.

    SECTION II: THAT the property described herein is subject to compliance with the following stipulations:

    1. Development of the property shall be in substantial accord with the revised site plan submitted with any significant changes or additions requiring further review and approval by the Planning Commission.
