    Council Proceedings of the City of Shreveport, Louisiana

    April 22, 2008

    The regular meeting of the City Council of the City of Shreveport, State of Louisiana was called to order by Chairman Joe Shyne at 3:03 p.m., Tuesday, April 22, 2008, in the Government Chambers in Government Plaza (505 Travis Street).

      Invocation was given by Councilman Wooley.

      The Pledge of Allegiance was led by Councilman Bowman.

    On Roll Call, the following members were Present: Councilmen Lester (Arrived at 3:10 p.m.), Walford, Long (Arrived at 3:11 p.m.), Wooley, Webb, Shyne, and Bowman. 7. Absent: None.

    Motion by Councilman Bowman, seconded by Councilman Wooley to approve the minutes of the Administrative Conference, Monday, April 7, 2008and Council Meeting, Tuesday, April 8, 2008. Motion approved by the following vote: Ayes: Councilmen Walford, Wooley, Webb, Shyne, and Bowman. 5. Nays: None. Out of the Chamber: Councilmen Lester and Long. 2.

    Councilman Shyne: Mr. Mayor, if you don’t mind it, could I suspend the rules at this point to add our resolution for Linwood Middle School, and I’d like for you to give them a word of encouragement, because they’re a good looking group of young men, wouldn’t you say so?

    Mayor Glover: Outstanding group of young men.

    Motion by Councilman Shyne, seconded by Councilman Walford to suspend the rules to add resolution No. 120 of 2008.

    Mayor Glover: Mr. Chairman, as you all are voting, I’d like to add to that, not only to suspend the rules to add this resolution, but also make this an official part of the Mayoral Communications.

    Councilman Shyne: Great!

    Mayor Glover: So, we can start with them and then we can go right into the Mayoral Communications, cause we certainly want to join you all in helping to recognize and honor these outstanding young men.

    Councilman Shyne: Well okay, why don’t we just add this and then we’ll let you make this a part of your distinguished guests since they would be distinguished guest, wouldn’t you say so?

    Mayor Glover: Well now Mr. Shyne, you know my position is that anybody that who goes through the time and trouble and effort of coming all the way to downtown Shreveport to attend any meeting or function of the Shreveport City Council and the Shreveport Mayor’s office, is not only a special guest, but they are distinguished guests as well. But these are especially outstanding and distinguished young men that we have here today.

    Councilman Shyne: Mayor, I’ve heard you say that time and time again, and you really have a beautiful choice of words, and you really understand how to use the King’s language.

    Substitute motion by Councilman Shyne, seconded by Councilman Walford to suspend the rules to add resolution No. 120 of 2008. Motion approved by the following vote: Ayes: Councilmen Walford, Wooley, Webb, Shyne, and Bowman. 5. Nays: None. Out of the Chamber: Councilmen Lester and Long. 2.

    Awards, Recognition of Distinguished Guests, and Communications of the Mayor which are required by law.

    Councilman Walford: Before we go on, I’ll give you a motion to adopt Resolution 120.

    Councilman Bowman: I’ll second that.

    Read by title and as read, motion by Councilman Walford, seconded by Councilman Bowman to adopt Resolution No. 120.

    Mayor Glover: Mr. Chairman, as he’s preparing to read it, I want to ask these young men to step forward and come here and join me at the dais, and line up behind me like it’s a Coach’s huddle at a time out.

    Councilman Shyne: And yeah, would you ask their Counselor or Assistant Principal, Ms. Rogers, the young lady who is dressed so neatly in the white suit?

    Mayor Glover: I thought that looked like Mrs. Rogers Chairman Shyne, but I thought it might be an 8th Grader at Linwood. I thought they had brought maybe the Captain of the Cheerleading squad here today, but (inaudible)

    Councilman Shyne: Now, he’s trying to get you to bring some cookies down here for us.

    Mayor Glover: To come up and join us please.

    Councilman Shyne: That’s what he’s trying to do. He want’s you to bring him some cookies. Coach, let Ms. Rogers through so she can come right there beside the Mayor, and look before you all start taking all the pictures, I’m sorry, I want to take a picture too beside Mrs. Rogers. Mr. Thompson, would you please - - - I’m just selfish to this.

    Councilwoman Bowman: How are you Ms. Rogers?

    Ms. Rogers: I’m good Ms. Bowman, how are you Commissioner Bowman?

    Councilwoman Bowman: Good.

    Ms. Rogers: It’s good to see you again. I’m sorry City Councilman Bowman.

    Councilwoman Bowman: That’s okay.

    RESOLUTION NO. 120 OF 2008

    A RESOLUTION TO CONGRATULATE THE LINWOOD MIDDLE MATH, SCIENCE & TECHNOLOGY (MST) MAGNET SCHOOL BOYS BASKETBALL TEAM FOR WINNING THE CADDO PARISH LEAGUE ONE AND STATE ROUND BALL CLASSIC CHAMPIONSHIPS AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    BY: COUNCILMAN JOE SHYNE

    WHEREAS, the Linwood Middle Math, Science & Technology Magnet School’s Boys Basketball Team won the Caddo Parish Boys League One City Championship and the State Round Ball Classic Championship; and

    WHEREAS, the Linwood Middle MST Magnet School competed with Caddo Parish schools to win the League One Championship and schools throughout the state to claim the Round Ball Classic Championship for the 2007 – 2008 season; and

    WHEREAS, the Linwood Middle School Boys Basketball Team finished the season with a 23 – 0 winning record; and

    WHEREAS, the team roster includes Brandon Brown, Savion Brown, Steve Coleman, Timothy Gaines, Trenton Hall, Buford Johnson, Christopher Mills, Dorriente Moses, Travonte Myles, Joshua Player, Ronnie Prelow, Joe Robinson and Joshua Robinson; and

    WHEREAS, while the Linwood Boys Basketball team, known as the "Wildcats" has many outstanding players, all of whom made important contributions to the team’s success, the following players received the following honors this 2007 – 2008 season:

    NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Shreveport, in due, legal and regular session convened, that the City Council congratulates the Linwood Wildcats Boys Basketball Team along with Head Coach Cedric Thomas and Assistant Coach Larry Smith for winning the League One Championship and the Round Ball Classic Championship, its undefeated record and for the many other successes the team has enjoyed this 2007 – 2008 season.

    BE IT FURTHER RESOLVED, the City Council wishes the Linwood Wildcats the best of luck and every success in their future endeavors.

    BE IT FURTHER RESOLVED, that this resolution shall be executed in duplicate originals and one original shall be presented to Linwood Middle MST Magnet School Head Coach Cedric Thomas and an original shall be filed in perpetuity in the Office of the Clerk of Council for the City of Shreveport.

    Motion approved by the following vote: Ayes: Councilmen Walford, Wooley, Webb, Shyne, and Bowman. 5. Nays: None Out of the Chamber: Councilmen Lester, and Long. 2.

    Mayor Glover: I can’t say it any better than what this outstanding Resolution already has. These young men are not only fine athletes, they’re fine students. And they’re fine citizens as well. So, there’s nothing else left to say accept to say that the Linwood Wildcats, are not just champions, but they are undefeated champions with great pride, and with great honor, I present to you Coach (he has a great first name doesn’t he), this resolution in honor of the accomplishments of you, your team, the faculty and the staff at Linwood Middle School. Want you to please come to the mic and please make some comments. And Ms. Rogers and anyone else that you all have to please step forward and share with us what you will.

    Coach Cedric Thomas: First of all, we are very honored for you all to have us here today on behalf of Ms. Monica Jenkins Moore who is our Principal, on behalf of Linwood Middle Math Science and Technology (MST) School. Ms. Rogers and my Assistant Coach, we appreciate you taking time out your busy agenda, and honoring these young men that we have here today. Hopefully, they’ll take this recognition and let this be a motivation in their lives and hopefully, I’ll bring another undefeated team I guess in the future, and they’ll be sitting in some of your seats (inaudible), and I just want to say thank you.

    Ms. Rogers: Good evening once again. To Mayor Glover, and our Councilman, Joe Shyne, and all those distinguished persons here today. We really want to thank you for honoring our team with this resolution on today. Our Principal Monica Jenkins Moore is not here today, but once again, on her behalf, we truly thank you because we are a school about academics, but we’re also a school of athletics. Thank you very much.

    Councilman Shyne: Ms. Rogers, I want to just comment on that. This is one of the top schools in the city, one of the top schools in North Louisiana, and they just so happen to be located in District F. We are extremely proud of you all, because you all are also known for your academics, not only for your athletics, but you’re know for your academics, and that’s extremely important. Coach, and Ms. Rogers, Assistant Coach, we are so proud, we are so proud to have you all down here and I guess I’ll go home and do a couple of flips. Thank you.

    Councilwoman Bowman: I never want to pass up the opportunity to say something to our young people. Young men, I’m really proud of you. I hope with the same enthusiasm you use to play basketball, you’ll use that in your community. That you’ll get out in your community and get involved, and while I’m sitting at home a few years from now in my rocker, I can see some of you sitting up here. Thank you for all that you do.

    Mayor Glover: Before you all take your seats, I want you to each understand that what this resolution does today is that it permanently makes each and everyone of you a part of the history of the City of Shreveport. This resolution will be a permanent part of the records of the City of Shreveport, and then those are held in perpetuity, so that from this day forward, each and every name that was called from this day forward will be a part of this City’s history. So, you all are history makers here today. And in my estimation, I believe it’s just a start of the great history that each and everyone of you will go on to make, but the one thing that you will always be able to do in the years hence, is that you’ll be able to look back on the 22nd of April, 2008 at this regularly scheduled meeting of The Shreveport City Council, and you’ll be able to scan down through those minutes and each and every name that’s standing here before us today will be a part of today’s proceedings. So, keep making history young men and thank you all for all that you’re doing.

    Councilman Shyne: So, we’re going to pause for a minute, if you all need to go back to the school, then we’ll give you all an opportunity to (inaudible). Ms. Rogers, again thank you hear? You work so hard at that school.

    Ms. Rogers: I am the public relations person, our Principal is Monica Jenkins Moore, (inaudible) Beverly Hudson.

    Mayor Glover: And I would be remiss, if I did not mention that Principal Monica Jenkins Moore is a graduate of the Caddo Magnet High School. I’m a member of the Class of ’83, she’s a member of the Class of ’84. My sister, Rosalind Glover Bryant, only recently left Linwood, where she was in fact the counselor. So great school, great faculty, doing outstanding things.

    Councilman Shyne: Mr. Mayor, excuse me, but I saw your sister today, and she was having a little problem with her arm, and she said this was the arm that she used in order to whip Cedric across the back when he was growing up.

    Mayor Glover: All of my folk have operative right arms from having to whip on me Mr. Shyne. It’s the only thing that accounts for me being able to stand here before you today. I was a bad young man. You know that. And was only that kind of love that they showed me at a young age that kept Chief Whitehorn and his charges from having to whip on me later in life. So I thank them. She’s a small woman, but she packs a mighty punch. And she can be a little mean every now and then. But that’s only if she has to.

    Councilman Shyne: Must be that Bradford in her.

    Mayor Glover: Well now you know that as well. I tell them I apologize for that stiffness that they experience especially on cloudy days like today when the humidity is a little bit high. But it turned out to pay off a little bit. In addition to recognizing these fine young men from Linwood, Mr. Chairman and members of the Council, it is also my great pleasure to recognize Mr. Neil Ferdinand Nathan. Would you please come up and join us, and bring with you all the folks that you have with you. I see at least one camera back there, so I know we got someone who wants to take a picture. So all the folks who are here on behalf of Mr. Neil Ferdinand Nathan, I want you to come up here as well. Two cameras. There we go! Alright Mr. Nathan is a 5th Grader at S. Highlands Elementary Magnet. He is Louisiana’s 2008 Elementary School Student of the Year.

    Councilman Shyne: Wow, that’s great. Hallelujah.

    Mayor Glover: And note, I did not say Caddo Parish, I did not say Northwest Louisiana, but all of Louisiana from Homer to Houma. Top to bottom.

    Councilman Shyne: You might tell them where Homer is.

    Mayor Glover: Homer is Claiborne Parish, and Bea, that’s spelled H O M E R. Houma is down in the southern part of the state.

    Councilman Lester: Terrebonne Parish.

    Mayor Glover: Thank you Mr. Lester. And it’s H O U M A. So, from Homer to Houma, Mr. Nathan is IT for this year. The State Department of Education’s selection committee chose Neil from a field of 18 regional finalists from across the entire state. We’re told that Neil’s superior academic record, his zest for learning, leadership qualities and his service to others earned him the State’s top award. As elementary school student of the year, Neil received a $500 savings bond donated by the Entergy Corporation. Today because of all that Neil has accomplished, he receives the Mayor’s Award of Educational Excellence. Keith Burton is his here today. His parents could not be with us, but I know that they wish us all well. This young lady, Big Sister? This is his babysitter, and so at this point, we’re going to present young Neil with his award, we’re also going t present you with this pin which makes you an official Deputy Mayor, and we’re also going to ask that you step forward if you will, and make some comments to the members of the City Council and the City of Shreveport.

    Mr. Nathan: Well, I’m really honored to be the Louisiana Student of the Year, and also I feel very lucky and thankful because I knew that there were a lot of other deserving candidates that could have been the Student of The Year. So, I’m very thankful to the judges who selected me. And it’s just really great to be Student of The year. I’m really happy and excited.

    Councilman Shyne: Since we don’t have an award, we’re going to ask you to come around and give you a handshake, starting with Mr. Lester.

    Mayor Glover: I think all of us who are up for re-election should be glad that it’s about a decade or so, before Neil will not only be able to vote, but to run. Very impressive young man, that I know is destined for great things. And thank you Neil for coming and being here with us today, and we want to recognize his Principal, Mr. Burton for being here as well. Thank you very much. Next, I’d like to call up Ms. Judy Ball Johnson.

    Ms. Johnson: You didn’t know it was me did ya? Remember me?

    Councilman Wooley: I do.

    Mr. Dark: Looking like someone whose been in detention.

    Ms. Johnson: (Inaudible) right?

    Councilman Wooley: Right, South Highlands. 3rd Grade. I thought that was you. I kept looking.

    Mayor Glover: Still have some un-served time in detention possibly?

    Ms. Johnson: No, he was a really, really good student. Did I get it right?

    Councilman Wooley: So it’s recorded in the City of Shreveport.

    Mayor Glover: Mr. Chairman and members of the Council, I am honored today to be here to present Mr. Judy Ball Johnson. Exemplary Art educator at South Highlands Elementary Magnet. To add to her many honors and recognitions, she has been recognized as Teacher of the Year, My Favorite Teacher, Louisiana Teacher of Distinction. Now to add to that this year Ms. Johnson was recently named by the National Art Association as it’s 2008, not Caddo, not regional, not southern, but National Elementary Art Educator of the Year.

    Councilman Shyne: Wow, wow, wow, wow. Look at the human treasures we have here in Shreveport, LA.

    Ms. Johnson: I did my student teaching when you were - - - you used to be “Coach” Shyne at Green Oaks.

    Mayor Glover: For over 30 years in Caddo Public Schools, Ms. Johnson has touched the lives of thousands of children by introducing them to the expressive and creative world of art. Many have excelled, becoming award winning Artists. She is one of a kind, the best of the best, a true champion for education, and we are proud to have her today as one of our own. We are proud to present Ms. Johnson, the Mayor’s Award of Excellence for all that you’ve accomplished. And one other thing I’d like to add because I discovered several weeks ago at the kickoff for the Arts in Education, Art Break Announcement, Ms. Johnson also taught with my father, the late Clarence E. Glover, Sr., at Fairfield Elementary School.

    Ms. Johnson: No, at Newton Smith.

    Councilman Long: She’s going to straighten you out!

    Mayor Glover: Newton Smith, my dad’s last teaching assignment and shared with me some very kind words and very kind thoughts about my dad. I thank her for that. So, I’m very proud on behalf of the City of Shreveport, members of this City Council, also on behalf of the memory and legacy of my father, to present to you this Mayor’s Award of Excellence. Thank you so much. This makes you an official Deputy Mayor of the City of Shreveport.

    Ms. Johnson: Alright. Thank you. I’ve done this for 33 years. And to be able to walk into that classroom everyday, and still be excited about teaching little children about art, how lucky can I be? It’s been a dream world. Started out with you didn’t it. That was our first year. And now has ended up with this, and I thank you all. Thank you, thank you.

    Councilman Lester: Thank you Mr. Chairman. Really briefly, I just wanted to tell Ms. Johnson, thank you. My daughter is in the Arts class and thanks to your instruction, we can actually enjoy the walls of our house as opposed to some of her other creative adventures, at least she’s on the canvass, and so she insisted on having a canvass and easel in the house, and so we have paintings of hers all over the house, and it’s in large measure to the fun that she has in your Arts class. So, I really do appreciate it. Thank you very much Mr. Chairman.

    Mayor Glover: Thank you Councilman Lester. Thank you Ms. Johnson. We look forward to having the official kickoff of Art Break is going to be April 28th. Am I correct? April 28th, Shreveport Convention Center running through May 4th. So we want to encourage the Council and everyone that’s out there watching, to please join us. At this point, I want to invite a gentleman who has served the City of Shreveport for a long but well and (inaudible), Chief Glenn Schach, would you come up and join us? Now the presentation that I have for him is not quite (inaudible).

    Councilman Shyne: Whoa! Look like a farm boy today.

    Mayor Glover: Is that your daughter back there with you?

    Chief Schach: Yeah, that’s my daughter.

    Mayor Glover: Bring your daughter on up here as well. You won’t join us? We’ll talk about you from up here then. I want to take a moment and publicly recognize Glenn Schach for the little over 30 years of service to the Shreveport Police Department. Chief Schach recently retired as Assistant Chief in charge of the east side, prior to that, he was the Assistant Chief in charge of the largest division within the Shreveport Police Department, the USD (Uniformed Services Division). Over the years, he has worked in every area and every level of law enforcement here within the City of Shreveport. He’s a man who loves law enforcement. He loves the work that he has done for so long, and I for one, hate to see him go. But I told him that before we would allow him to leave, he share some words at the last promotion ceremony, where we had the opportunity of presenting another history maker for Shreveport. But I told him that I would not allow his retirement to be complete without inviting him to come here to appear before the City Council, and be publicly be recognized and to also have an opportunity to share whatever might be on his heart with the rest of the city. And so, Chief, I want to thank you for your hard work, your long hours, your sacrifice, I did understand that based upon the retirement ceremony, that there were three things that your wife would be getting upon your retirement. One was that she would get her pool boy back. The other, I can’t remember quite exactly what it was, but there was one that the Chief wouldn’t read.

    Chief Schach: And we’re not going to talk about today.

    Mayor Glover: But I might say that at least he’s looking forward to having someone to play with on an ongoing basis. So, Chief, I want you to just let the folks know just what’s on your heart, to say to you how much we appreciate you. And that we know that there’s a possibility that I’m going to be looking to call on you form time to time, for a little bit of advice and guidance and support and some insight. And so I don’t want you to go too far. I know that you’re safely (inaudible) here in Southeast Shreveport. Grew up in the Cherokee Park section of our city, and has just gone from the northwest corner to the southeast corner. But is still safely here. And so thank you so much for everything that you’ve done, and appreciate everything that you’ve given to the City of Shreveport.

    Chief Schach: Thank you Mayor. Mr. Dark, good to see you again. City Council, I’ve spoken with all of y’all several times. I want to tell you Mayor, Council, thank you for your support of the police department. And obviously in 30 years, I’ve seen times when we weren’t supported as well as y’all are doing today. It sure makes the job a lot easier for the men and women who go out and do the job everyday. Some of the successes that I have had was because of the people around me. You are truly blessed with a very good police department here. It’s like with this small segment of society we have out here who are the trouble makers, the ones that don’t do right. Well, we only have a small, small few in the police department who don’t live up to the standards. And I’m sure that Chief Whitehorn will deal with that as he gets to it. I want to thank Chief Whitehorn, Chief Jeter, Cpt Hayes, Assistant to the Chief Huddleston, all of my friends and co-workers. Without them, would not have achieved some of the successes that I did. The only thing that I would ask of this Council and this Mayor as a citizen and a resident of Shreveport, and I’m going to remain a resident of Shreveport, is your continued support of the police department, and continue to find funds available to pay these men and women what they truly deserve. And I thank you.

    Mayor Glover: Mr. Chairman and Members of the Council, while she won’t come up to the mic to accept any of her accolades, I do want us to do is to also give a round of applause to Mrs. Schach, to be the wife of a police officer for 30 plus years, involves a heck of lot of sacrifice, a heck of a lot of commitment, a heck of a lot of worry. And so we just want to thank her, and we wish them both the best, and we know that they’re going to enjoy retirement, and I can hear the motorcycle outside rumbling, right now that I know he’ll be riding before too long. In conjunction with that, the retirement of Chief Schach created an opening that had to be filled. A vacuum that simply had to have someone step forward to take his place. And in doing so, it afforded an opportunity for the City of Shreveport to cross a boundary that had not yet been crossed before. I’m not sure, and if all the annals of the history of the City of Shreveport has ever been Mr. Chairman and Members of the Council, an Assistant Chief who was under 5’ 2” tall. But it just so happens that that history was made just a week or so ago, and so I want to invite Assistant Chief Cheryl Jeter to come up.

    Councilman Shyne: Mr. Mayor, she just might hold that record forever. I can’t foresee of anybody breaking that record.

    Mayor Glover: She might hold it forever, we don’t know. But she was without question a great member of the Shreveport Police Department. Has served this city extremely well. I’ve enjoyed the time that she and I spent, the year plus that I’ve been the Mayor of this city. The emails that we’ve exchanged, the work that she’s put forth over at the detective division where she was prior to her promotion. So I know that she’s going to continue that legacy of excellence without question. And I gave her a little nickname, because she happened to help solve a significant crime. You don’t want me to tell that story?

    Chief Jeter: I’m not sure what you’re going to say.

    Mayor Glover: She and her guys happened to have solved a significant crime just before her promotion. And she said it was her parting gift as she was moving on. And I responded by no means should she consider it a parting gift. In fact, she should get accustomed to being referred to by me as Mrs. Claus. Because I know that she is going to be helping to bless this city with lower crime rates, and more effective police protection all across the board with the dedication that she’s going to bring to the job. So, I’m here to present to you all today the shortest Assistant Chief ever in the history of the City of Shreveport.

    Councilwoman Bowman: Question. Isn’t she the only female Chief?

    Mayor Glover: Well now, I hadn’t noticed that.

    Councilwoman Bowman: Well guess what. We’ve got to give the Sistah credit!

    Mayor Glover: Somebody told me I was the first Black Mayor and I couldn’t believe that either. I just told them they never had one that was 6’ 4”, 350 lbs before. But I guess you’re right.

    Chief Jeter: Okay, I wasn’t expecting this, but most of you, all of you know me, because we visit on a regular basis about various things. And I just hope that I can continue to serve the city, serve the Council, the Mayor, the Police Chief in a manner that I have in the past 28 years. I look forward to it. And y’all know how to find me, I know that. So, if you’ve got something that you need to send to me, send it on. I’m ready. Thank y’all for recognizing me today, I really appreciate that. And I’m actually only 5’ tall.

    Councilman Lester: (Inaudible) Mr. Big in the program Mr. Mayor. Two inches on the program.

    Mayor Glover: Exactly Chief Jeter, Councilman Lester just reminded me, when it comes to writing out the official programs, coaches always list their players that are a little taller, and a little heavier, and a little faster - - -

    Chief Jeter: (Inaudible).

    Mayor Glover: I remember we got you officially listed as 5’ 2”, 115. And at this particular time Mr. Chairman, Members of the Council, I’d like for you all to hear a presentation from a group of individuals that myself and Mayor Walker from over in Bossier as well as members of our respected staff met with earlier today. They are from Louisiana Department of Environmental Quality. Mike, I’m going to give some direction. Come on up and tell us specifically and exactly who they are. I sat in and listened and just kind of shook my head. And I told them I wanted to not just bare this burden alone as the Mayor of the City of Shreveport, but it was something that obviously had some implications for all of us throughout this region. For you all sine we are in regular Council Meeting today, to have a chance to be able to hear from him as well. And at this point, I’m going to turn it over to Mike.

    Mr. Strong: At this point, I’d like to introduce Lou Buatt. Lou is the Assistant Secretary with DEQ. We had asked DEQ to come up and give us a briefing on the new air standards that are going into affect, that have already been in effect and been passed by EPA. Which is probably going to put us either close to or very close to non-attainment. And so our situation on that is very important. They gave about an hour presentation. Tom asked if they could do about an hour and a half. I said no, not over two or three minutes. This is just to give you some information on what’s going on.

    Councilman Shyne: That was suggested by Tom Dark over there?

    Mr. Dark: Mike is lying.

    Mr. Strong: It’s very important for our area in what it has the potential to do. But this is the beginning, and we’ve got issues that are going to come up that are going to have to be addressed in about the year 2010-2013. But let me introduce the Assistant Secretary of DEQ, Lou Buatt.

    Councilman Long: Mike you said issues that the City is going to face itself individually, or as a city - - -

    Mr. Strong: As a metropolitan area that’s in this is all of Caddo Parish, all of Desoto Parish, and also Bossier Parish.

    Councilman Long: And this is public and private industries?

    Mr. Strong: This is everybody. It addresses the whole situation of where Baton Rouge has been in non-attainment for years. And then now with the change in regulations and understand that the regulations (inaudible) to the point .75 ppo, where it was .84 in some of the other groups, it wanted it to go down as low as .60. This is the things that we’re going to have to address.

    Mr. Buatt: It’s a pleasure to appear before this distinguished body and it’s members, and I want to thank Mayor Glover and Mike Strong for having us over, and also opportunity for Wes Wyche for putting this together, and including some of the local elected officials in the surrounding parishes and cities. As Mike was telling you, and I’m just going to get right to the brass tacs. The EPA revised ozone standard this year, on March 12th to .0. It used to be at .08, which is parts per million which is 80 parts per billion to 75 parts per billion. And it’s a pretty significant change. Now, does that mean your air quality is getting worse? No, in fact over the years, your air quality in this area and actually throughout the state has progressively been getting better and better, and better. The EPA set forth some time schedules for implementation of this new standard and by next year, the department is required to propose designation of what areas in the state are not non-attainment, what areas of the state are in attainment. The bad news is all metropolitan areas in the State of Louisiana except the Monroe metropolitan area are going to be in non-attainment. Now that doesn’t include Alexandria. They don’t have a monitor. Their monitor at some point had gotten destroyed. So, all of the metropolitan areas that are monitored absent Monroe, and still Monroe could still fall into this. They are very close. They’re at 73 parts per billion. So, we still have another ozone season to go, so they still could fall into this. So instead of this ozone thing being a Baton Rouge problem, it is now a State problem. And more importantly to you folks it’s going to be a City of Shreveport problem, a Caddo Parish problem, a metropolitan statistical area problem of Caddo Parish, Bossier Parish, and Desoto Parish. You have two monitors. One of them is in Bossier Parish, which is oddly enough the Shreveport monitor at the Shreveport Airport, and then you have the DC monitor that’s off Hwy 71 near Dixie. And the current design values for those stations were at 79. So the standard is used to be 80. You were just under that at 79. The standard now is 75, and that’s going to have impacts. It’s going to have economic impacts to this area. It’s going to have impacts to small businesses such as dry cleaners, gas stations, paint and body shops and the like. Fuels for summertime ozone, there are special fuels that have lower vapor pressure that will have to be employed here, under the clean air act. If you get bumped up to levels of non-attainment, you may have to have reformulated fuels. Gas stations may have to have 1st and 2nd stage recovery systems, which can also potentially increase the fuel cost to your citizens of this area. Yes sir vapor recovery systems, right. And there’ll be increase to the ozone alert days that are now on the weather channels. There again, that doesn’t necessarily mean that your air has gotten worse. In fact, we figure air has gotten better, but the citizens in the area may have a perception that the air is getting worse. There’s going to be a significant impact to local governments, especially with regard to your highway projects or other federally funded projects, because when you’re not in attainment, you have to go through what they call for highway projects, a transportation conformity analysis, which can delay some of you highway and road projects, and other projects with a general conformity analysis where there are federal funds that would be used to supplement some of those projects. So, there certainly is some potential impacts. Now, with all that said, the State of Louisiana has been very, very proactive. We have put together a state-wide ozone steering committee. This committee is a broad based committee that includes industry folks, state agencies, such as the DEQ like the Department of Economic Development. EPA also participates. We have environmental groups, we have everybody covered. Small business folks covered. Gasoline retailers, so on and so forth. We have the Baton Rouge Clean Air Coalition is represented on this committee. They have lots of experience, and we want them to share their experiences, their lesson learned with all of these areas that have now come into this maze. We have a challenge ahead of us. We’re going to need your help, and we’re here to help you. The steering committee is made of a group of folks that have a lot of expertise and experience in dealing with these issues, and we’re going to be dealing with your Administration, Mike Strong, Wes Wyche, Mayor Glover and others to see what we can do get this area into attainment sooner, rather than later. And in fact, try to come up with strategies to avoid non-attainment. The primary objectives of this state-wide ozone steering committee is to provide education and awareness to all the folks around the state with local government folks, and their communities is what all this means. The second thing is to encourage you all to develop local clean air coalitions to work with us. The third thing is that we put together a subcommittee to come up with some strategies to implement basically statewide or regional wide measures that can get us out of this non-attainment maze sooner, rather than later. And lastly, and one of the most important things is the Clean Air Act, the federal law that imposes all these things is really antiquated and outdated, and really needs to be reformed. And we’re going to need your help to get reforms. And we’re starting a grass roots campaign so to speak (inaudible) to get that going. We’re talking to congressional delegation. Your input to the congressional delegation on these issues will be very important. That’s pretty much the brass tacks of it. Be happy to answer any questions. Will be working with Mike Strong, Wes Wyche, Mayor Glover and others.

    Councilman Long: Besides, lets say car exhaust, hydrocarbon consumption bi-product, what is the largest pollutant of those?

    Mr. Buatt: You have two precursors that result in ozone. You have volatile organic compounds, which are the vapors from organic - - - gasoline, so on and so forth, and other chemical compounds (inaudible) into the air. Some of those are from natural sources, pine trees and etc., and then you have other man made sources from industries, plants, so on and so forth. And then you have nitrogen oxide is the other precursor. And that comes from combustion of fossil fuels. These two compounds combine into lower atmosphere and on hot days in the presence of sunlight, basically cook and become ground level ozone. And the ground level ozone is irritant to lungs, and can exacerbate bronchitis, and emphysema and things of that nature.

    Councilman Long: Thank you for that, and it confirms what I thought. You know it’s all a function of vehicle and vehicle use and all these things. And quite frankly we’re converting our auto fleet slowly, but surely into hybrid cars. And I know that’s expensive. But we bought one and we’re planning on buying another one. Another thing that’s of recent interest locally, and then it’s actually been ongoing, but it’s going to probably get more prolific as time goes along is oil and gas production. And especially with the recent discovery of the (inaudible) and some other gas zones that are prevalent in this area. And the proposed drilling of that. And lets face it, just the drilling process itself, which I’m all for, because America is having it’s own energy independence, I’m good for that, and I personally benefit from it, but you know in the same breath, there is a lot of that going on and that’s going to impact our local ozone levels as these wells are drilled and brought on line, and just a lot of potential just releases activities surrounding the gathering and pipelining and all that. So, is that obviously going to be a factor?

    Mr. Buatt: There are potential for all those things. There are measures that can be taken to mitigate, impacts from those sorts of activities. But those measures don’t come free, those measures come from a cost, and that’s one of the consequences of being in non-attainment. When you’re in non-attainment and you come into start a new business, and it’s an industrial type activity, your permitting requirements are more stringent, and your pollution control devices that you have to employ are expensive, and more difficult or often times, more technically challenging to operate, which results in increased cost of doing business. Which means if everything being equal, non-attainment/attainment area industry or folks move to where the less cost of doing business. And that adversely impacts your local economy.

    Councilman Walford: What about rendering plants?

    Mr. Buatt: No comment.

    Mr. Strong: Appreciate the opportunity, but to let you know we’re impacted by a lot of transportation. The air from down south, from South Louisiana to the Houston area also that is coming up here. We do have overall good air up here, and let it be understood that’s on there, the trees (pine trees) impact what is the beginning, or what is our basis for looking at that, and that’s the thing that we do. Just wanted to give you a quick update. Thank you very much.

    Mayor Glover: Actually Mr. Chairman, Mr. Seaton is in Baton Rouge as a part of our legislative team down there, and so rather than send Chloe Haygood on the road, I try not be chauvinistic, but - - -

    Councilwoman Bowman: No, you just let her ride shotgun.

    Mayor Glover: The father in me makes me a little bit reluctant to send women on the road by themselves. So, we sent Rick down there with a tuna fish sandwich and a stick of bubble gum, and told him to hold out until I get there tomorrow.

    Councilman Shyne: That’s pretty good, because there’s a rumor that Chloe doesn’t drive very well on the highway. Now, I don’t know whether there’s any credence to that or not?

    Mayor Glover: No, I don’t think the issue is whether she drives well, I just think that she drives very fast. And there’s some controversy about a particular bill in the legislature regarding small towns and traffic tickets, and what have you, and I just didn’t want to have them make up their quotient on Ms. Haygood just in case they ended up having some limitations placed on them in the future.

    Councilman Shyne: And then I see too, you’re not in a position to call the head of the State Troopers anymore to give you some relief. So you have to kinda play it safe.

    Mayor Glover: Absolutely. We don’t have that luxury anymore.

    Councilman Shyne: That’s right. I knew for three or four years, you had that luxury, you could call the head of the State Police in order to get a little relief for some of your friends. So, you just decided to keep Chloe here. I think that was a good move.

    Mayor Glover: She will get a chance in all seriousness Mr. Chairman and Members of the Council, to get her Baton Rouge and Washington time in before it’s all said and done. We’ve got her riding in the ‘on deck’ position today.

    Councilman Shyne: You know I think she’ll probably enjoy D.C., because you know D.C. is a chocolate city. Did I say anything wrong? Okay, lets move on.

    WHEREAS, Johnny Dee=s Lounge located at 4044 Mansfield Road will host its Annual Crawfish Boil on May 17, 2008; and

    WHEREAS, the establishment desires to dispense, and allow the consumption and sale of alcoholic beverages on the parking lot of the establishment, between the hours of 12:00 p.m. - 12:00 a.m., with no music being played outdoors after 8:00 p.m.; and

    WHEREAS, Section 106-130(6) provides that unless otherwise excepted, all uses shall be operated entirely within a completely enclosed structure; and

    WHEREAS, any special exception approval granted to the establishment for alcoholic beverage sales, consumption and/or dispensing does not specifically authorize outside sales and/or consumption on the premises; and

    WHEREAS, Section 10-80(a) makes it unlawful for any person to sell, barter, exchange or otherwise dispose of alcoholic beverages except within those sections of the city wherein such sale is permitted by the applicable zoning ordinance; and

    WHEREAS, Section Chapter 10-103(a)(5) provides that the city council may suspend or revoke any permit if a retailer allows any person to consume any alcoholic beverage on the licensed premises or on any parking lot or open or closed space within or contiguous to the licensed premises without a proper license; and

    WHEREAS, the adoption of this resolution would allow the dispensing, sale and consumption of alcoholic beverages on the parking lot of Johnny Dee=s Lounge, 4044 Mansfield Road, on May 17, 2008 for the Annual Crawfish Boil, with no music being played outdoors after 8:00 p.m.

    A RESOLUTION TO SUSPEND THE EFFECTS OF SECTIONS 26-291 AND 26-292 OF THE CODE OF ORDINANCES RELATIVE TO THE DISPOSITION OF NONOPERATING MOTOR VEHICLES ACQUIRED BY THE CITY OF SHREVEPORT PURSUANT TO LSA-R. S. 33:4876 AND SECTIONS 38-31 AND 38-32 OF THE CODE OF ORDINANCES AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    BY:

    WHEREAS, LSA-R. S. 33: 4876 authorizes municipalities to enact ordinances regulating or prohibiting the storing or abandoning of junk, wrecked or unused automobiles or motor vehicles, or any part of parts thereof, on any vacant lot, or any unused portion of any occupied lot, neutral ground, street or sidewalk within the municipality; and

    WHEREAS, the statute also provides that any vehicle remaining on the public way or private property after written notice to the owner shall be considered as public property and disposed of by the municipality as the governing authority may designate; and

    WHEREAS, pursuant to such authority, the City has adopted Sections 38-31 and 38-32 of the Code of Ordinances prohibiting the exterior storage of nonoperating vehicles on any dwelling, dwelling unit or premises and providing for notice of the violation to the owner of the vehicle or property where the vehicle is located; and

    WHEREAS, Section 26-291 of the Code of Ordinances authorizes the Purchasing Agent to dispose of surplus supplies, materials, and equipment determined by him to be surplus property and contains the procedure for disposition of the surplus property in accordance with state and city advertisement and competitive bidding procedures; and

    WHEREAS, Section 26-292 contains the requirements for sale, exchange, transfer or donation of surplus property and provides, among things, that the exchange or transfer of such property must be authorized by resolution in the same manner as a public contract; and

    WHEREAS, over the years, has contracted with a number of contractors for removal and disposal of the vehicles in accordance with the terms of the contract, state law and local ordinance; and

    WHEREAS, the City has recently been informed by the Department of Motor Vehicles that requests from contractor(s) for disposal of nonoperating motor vehicles must be accompanied by an Affidavit and Bill of Sale or other document intended to convey ownership of the nonoperating motor vehicle to the contractor; and

    WHEREAS, the requirement to competitively bid and/or obtain a resolution from the City Council in order to dispose of the vehicles has resulted in reduced enforcement of Section 38-31 et seq., as the current contractor is unable to dispose of the vehicles and has exceeded the storage capacity of his facility; and

    WHEREAS, adoption of this Resolution would suspend the effects of Sections 26-291 and 26-292 of the Code of Ordinances relative to the disposition of nonoperating motor vehicles acquired by the City pursuant to LSA-R. S. 33:4876 and Section 38-31 and 38-32 of the Code of Ordinances.

    NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shreveport in due, legal and regular session convened that the provisions of Sections 26-291 and 26-292 of the Code of Ordinances are hereby suspended until October 31, 2008 relative to the disposition of nonoperating motor vehicles acquired by the City of Shreveport pursuant to LSA-R. S. 33:4876 and Section 38-31 and 38-32 of the Code of Ordinances.

    BE IT FURTHER RESOLVED that all other applicable provisions of the City of Shreveport Code of Ordinances shall remain in full force and effect.

    BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items or application, and to this end, the provisions of this resolution are hereby declared severable.

    BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.

    Councilwoman Bowman: Thank you. That was my question.

    Mr. Dark: I’ll be glad to try, I wish Terri were here, it’d be easier. We have encountered a problem with the contractor, or the contractor has encountered a problem who is towing inoperable vehicles off vacant lots and things like that. Apparently, the State is giving them problems about the fact that in effect, they come off adjudicated property or something, they’re ours. And if we would have to do this the way it would normally is done, we would actually have to declare each individual car as surplus in order for him to be able to sell it, or for us to be able to sell it to anyone. What Terri is recommending that we do is that we’re suspending that particular provision just as it relates to these vehicles for a short period of time and trying to work out a different way to do it. But that’s all you’re being asked to do today, is to give us a way to dispose of those vehicles once they’ve been towed.

    Councilman Long: With a fix coming?

    Mr. Dark: With a fix coming.

    Councilman Shyne: I don’t think you all are asking too much of us.

As I tried to summarize a little bit yesterday, we are not getting as much CDBG entitlement, to the tune of almost $106,000 and not as much home entitlement to the tune of about of $63,000. This budget amendment reflects making the budget smaller to account for that.

    Councilman Walford: Mike are you the one to answer this one for me? Do I understand correctly that this is part of the Youree Drive widening of turn lanes?

    Mr. Strong: This is the Youree Drive/Kings Highway new intersection project, which is actually takes in from the Youree Drive on up to E. Kings Highway. And this is the little short section of road there which would be very close to Murrell’s that is coming into it, where it puts the whole intersection in.

    Councilman Webb: Are y’all going to take those trees down?

    Mr. Strong: There’s no trees there. There’s nothing.

    Councilman Walford: There’s a blank lot, and there’s a little short street.

    Mr. Strong: Now, if Mike can do the trees during Christmas time.

    Councilman Walford: Because DOTD requires it?

    Mr. Strong: Yes sir. And we’ve worked through, and we’re involved through the right of way, and how this will be set up and notifications of everything.

    Councilman Long: So, in the meantime, is this going to stay open or closed or what will happen to it?

    Mr. Strong: Well, what it’ll do until the construction project begins.

    Councilman Long: So, I can still use it as a cut through when I go through there.

    Councilman Walford: Me too!

    Councilman Long: Just a real quick question. Who owns all that space out there to the east of that intersection? Is that - - -

    Mr. Strong: I think that at this point and time the state is in the process of buying the right of way. I’m not sure whether it’s already been acquired or not by the state. But that’s where it was going.

    AN ORDINANCE AMENDING ORDINANCE NO. 172 OF 2007 RELATIVE TO THE 2008 BUDGET FOR THE POLICE GRANTS SPECIAL REVENUE FUND, CHANGING THE NAME OF THE FUND TO THE PUBLIC SAFETY REVENUE FUND AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    WHEREAS, Article 7 of the Charter of the City of Shreveport required the adoption of a comprehensive operating budget for the year 2008; and

    WHEREAS, the City has created a Police Grants Special Revenue Fund, to account for the receipt of and expenditure of funds provided to the City by various agencies to assist in specific law enforcement programs; and

    WHEREAS, the City has received fire related grant funds and has included those funds in the Police Grants Special Revenue Fund budget, therefore a more accurate title for that revenue fund would be “Public Safety Special Revenue Fund"; and

    WHEREAS, the City may receive other public safety grants not specifically related to police or fire operations, and those funds can also be included in the Public Safety Special Revenue Fund.

    NOW THEREFORE BE IT ORDAINED by the City Council of the City of Shreveport, in due, legal and regular session convened that Ordinance No. 172 of 2007 is hereby amended by changing the name of the Police Grants Special Revenue Fund to the Public Safety Special Revenue Fund. All funds appropriated and budgeted therein and in any subsequent ordinance amending Ordinance No. 172 of 2007 shall remain in full force and effect and all references to the Police Grants Special Revenue Fund shall now be deemed to refer to the Public Safety Special Revenue Fund.

    BE IT FURTHER ORDAINED that if any provision or item of this Ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this Ordinance which can be given affect without the invalid provisions, items or applications and to this end the provisions of this Ordinance are hereby declared severable.

    ORDINANCE NO. 34 OF 2008

    AN ORDINANCE DECLARING CERTAIN ADJUDICATED PROPERTIES NEEDED FOR A VALID PUBLIC PURPOSE AND OTHERWISE PROVIDING WITH RESPECT THERETO

    WHEREAS, the City of Shreveport has a tax interest in certain properties adjudicated for more than five years for the nonpayment of property taxes, said properties being more fully described below along with the names of the last known owner of record of each property and the names of the other interested parties of record for each property; and

    WHEREAS, under La. R.S. 33:2891.1 et. seq. property adjudicated to a city more than five (5) years for nonpayment of taxes or paving and other local improvement assessments, may be declared by the city as needed for a valid public purpose, defined in La. R.S. 33:2891.2 as “the revitalization of economically depressed areas by placing abandoned properties back into the economic stream of commerce”; and

    WHEREAS, each of said properties has been abandoned by its owner and the lack of use has contributed to the decline of this economically depressed area; and

    WHEREAS, the City of Shreveport intends to use this property for lease or other grants of use to persons or businesses, whether public or private, which will use the property for purposes which help to revitalize this area, or for any other valid public purpose.

    NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Shreveport in due, regular and legal session convened, that it does hereby declare the following described adjudicated properties needed for a valid public purpose:

    WHEREAS, today the Property Management Section of the Department of Operational Services has received a request to close and abandon a portion of the 40 foot-wide Clark Street.

    WHEREAS, Water and Sewerage Engineering has reviewed this request and has no objections to this closure and abandonment.

    WHEREAS, Water and Sewerage Engineering has reviewed this request and has no objections to this closure and abandonment.

    NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Shreveport in due, legal and regular session convened, that the 50 foot-wide Fisk Street, Located in the SW ¼ of Section 10 (T17N-R14W), Shreveport, Caddo Parish, and Louisiana and as shown and as indicated on the plat attached hereto and made a part hereof, is hereby closed and abandoned. Water, Drainage and Utility Servitudes are hereby retained.

    AN ORDINANCE DECLARING CERTAIN ADJUDICATED PROPERTIES TO BE SURPLUS AND TO AUTHORIZE THE MAYOR OF THE CITY OF SHREVEPORT TO SELL THE CITY OF SHREVEPORT’S TAX INTEREST IN CERTAIN SURPLUS ADJUDICATED PROPERTIES, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    WHEREAS, the City of Shreveport has a tax interest in the herein below described properties which have been adjudicated for the non-payment of City property taxes; and

    WHEREAS, the herein below described properties are not needed for public purposes and should be declared surplus properties; and

    WHEREAS, the City of Shreveport has received offers to purchase its tax interest in the herein below described properties as indicated below.

    Councilwoman Bowman: Additional comments from yesterday?

    Councilman Shyne: I didn’t want to say it like that, but I’ll agree with you on that. I was going to say if you had any remarks in relations to the Public Safety Committee Meeting?

    Councilwoman Bowman: We’ve had little discussions per emails, and I think what we’ll do is go on and try to get another Public Safety Meeting scheduled, and invite all Commissioners who are interested in coming. And of course Mr. Mayor, we’ll try to get it on a day when you are here. And that way, if anybody has any questions, or any comments, then we’ll be here to answer whatever needs to be answered. I think I used a little tact.

    Councilman Shyne: And Mr. Mayor, we might have to try to have that in your large conference room, because I wouldn’t want to, after hearing some of the remarks that was made by some of the Commissioners, I wouldn’t want to have us in a room where you know we might kinda be close to one another.

    Councilman Long: do it in here.

    Councilman Shyne: You’re right.

    Councilman Lester: Mr. Chairman? Ms. Bowman, have they reopened Irish McNeil, we could have it over there?

    Councilwoman Bowman: Well no. We can do it in open space.

    Councilman Shyne: Mr. Mayor, you might have to look at that, because I don’t want to get us - - -

    Councilman Lester: I want to go to Irish McNeil.

    Mayor Glover: Mr. Chairman, I’ll repeat what I said on yesterday. Now, they can pick on me all they want, but they start picking on the City Council, then I got a real problem with that. I’m a big boy, and I can take it, but when they start being unfair with this City Council, then I consider that to be a real affront. And take great umbrage at it.

    Councilman Shyne: Now, Mr. Mayor, I think one of the persons is a good friend of yours who - - - uh oh, I got some bad eyes from Michael, so Mike is telling off on himself.

    Mayor Glover: Like I say Mr. Chairman, they can pick on me all they want to, but when they start to unfairly accuse and attempt to castigate this (inaudible) City Council, then it really gets my dander up. And puts me in a fighting mood Mr. Chairman.

    Councilman Lester: I want to go to Irish McNeil.

    Councilman Walford: To suggest that this Council doesn’t communicate, I mean - - -

    Councilwoman Bowman: Mr. Chairman, I’ll tell you exactly what it’s like. It’s like we were kids growing up, and my sister and I could fight each other all day, and then the minute we get out in the street and somebody else comes up, we’re both going to jump on ‘em. So hey.

    Councilman Lester: Mr. Chairman, don’t we have an MMA facility at the Municipal?

    Councilman Shyne: Mr. Thompson?

    Letter: Case No. CA-03-08: Property located on the southwest side of Flournoy Lucas at its intersection with Ellerbe Road.

    Mr. Thompson: You just introduced the ordinance to allow the - - - to swap the property with the “Y”, both the appeal and the ability to adopt the ordinance will come up at the next Council Meeting, so you can decide the issue by adopting or not adopting the ordinance.

    Councilman Shyne: Okay. Was it anyone who needed some additional information? If so, do we have someone in the audience Mr. Thompson, that can provide us with some additional information if anyone needed any?

    Mr. Thompson: Mr. Mike Strong will be happy to meet with anybody who wants to meet and he can explain everything. You know he has a law degree too, he and Mr. Dark.

    Councilman Shyne: Oh, okay. I knew it was something.
