      Council Proceedings of the City of Shreveport, Louisiana

      October 9, 2007

      The regular meeting of the City Council of the City of Shreveport, State of Louisiana was called to order by Chairman Walford at 4:04 p.m., Tuesday, October 9, 2007, in the Government Chambers in Government Plaza (505 Travis Street).

        Invocation was given by Councilman Walford.

        The Pledge of Allegiance was led by Councilman Wooley.

      On Roll Call, the following members were Present: Councilmen Lester (Arrived at 4:05 p.m.), Walford, Long, Wooley, Webb, Shyne (Arrived at 4:05 p.m.), and Bowman. 7. Absent: None.

      Motion by Councilman Webb, seconded by Councilman Bowman to approve the minutes of the Administrative Conference, Monday. September 24, 2007 and Council Meeting, Tuesday, September 25, 2007, and the Shreveport City Council -Caddo Parish Commission Joint Meeting, October 5, 2007. Motion approved by the following vote: Ayes: Councilmen Lester, Walford, Long, Wooley, Shyne, Webb and Bowman. 7. Nays: None.

      Awards, Recognition of Distinguished Guests, and Communications of the Mayor which are required by law.

      Councilman Walford: Mayor Glover, welcome sir. Do you have any communications or distinguished guests?

      Mayor Glover: Yes I do Mr. Chairman.

      Councilman Shyne: Mr. Mayor, I believe they are very attractive too, if I’m not mistaken. Your guests.

      Mayor Glover: I’m just going to smile Mr. Shyne. Not sure if my wife watches this early.

      Councilman Shyne: Maybe I shouldn’t have said anything, because my wife might be watching.

      Mayor Glover: Mr. Chairman, members of the Council, thank you all. We have several items that we’d like to present to the Council and to the City of Shreveport during Mayoral Communications. The first starts with a young lady who is just simply an outstanding citizen of Shreveport and Northwest Louisiana. Linda Biernacki, would you join me?

      Ms. Biernacki: Thank you Mr. Mayor.

      Mayor Glover: You’re very welcome, honored to have you here. Now, I’m sure that Linda is probably known to each and every one of you, but in case you have not had the privilege and pleasure, this is Linda Biernacki, one of Shreveport’s most outstanding business persons, and an individual who has not only accomplished a great deal within the business and professional community, but was one of the civic giants within our city as well. Linda is involved with everything from the Committee of 100 to the Shreveport Chamber and all sorts of outstanding efforts from there and beyond, but in particular, we are honored here today to present to Linda Biernack this Mayoral Award of Excellence, based upon her support of the Shreveport Fire Department. She presented some 27 fire safety banners to the Shreveport Fire Department. And Chief would you all join me here as well please? These particular 27 banners will enable all 22 fire stations and fire sites throughout the City of Shreveport to promote fire safety during the month of October and for many, many years to come. Fire Tech Systems which is the company that Linda Biernacki is the head of, along with her the collective group that helped to provide these banners and Linda on behalf of this particular effort as well as so many the other wonderful things that you do for Shreveport, Bossier City, and Northwest Louisiana, it’s my honor and privilege to present to you this Mayor’s Award of Excellence to you and to all the fine folks at Fire Tech Systems, Inc.

      Councilman Shyne: Aw, that’s wonderful.

      Councilman Walford: Very nice.

      Mayor Glover: The Chief will have some remarks.

      Chief Cochran: Thank you Mayor Glover: Also to Ms. Biernacki, she provided for us 27 banners that we have placed in front of all our fire stations and the offices where our other divisions of labor are housed, and they’re absolutely beautiful. And we wanted to show our gratitude by providing her with one of the banners. And our fire prevention officers just displayed it before the members of the Council, and before the audience. And it just simply says ‘Thank You For Your support of the Shreveport Fire Department’.

      Ms. Biernacki: Well, I’ve got to say I’m extremely excited that we could be just a small, small participant of the Fire Prevention Week. The Fire Department, and all of the firemen and women, they are the real heroes here, they’re the ones that go out and teach our children how we need to - - - what we need to do in case of a fire. So, I’m just extremely humbled that I’ve received all this, and I’m grateful that we have a Class I Fire Department for our city. That’s very exceptional.

      Mayor Glover: And I might add before she takes her seat, the success that we’ve achieved so far with regards to efforts like I-49, Cyber Command, and so many other great, great, great endeavors here in Northwest Louisiana, one of the main shoulders pushing and shoving to make all these wonderful things happen, happens to be this young lady here as well, so thank you again Linda, and look forward to working with you on into the future.

      Ms. Biernacki: Thank you Mr. Mayor.

      Mayor Glover: Absolutely.

      Councilman Shyne: Mr. Mayor - - -

      Mayor Glover: Thank you Mr. Chairman and members of the Council. Our next presentation today will go to Catherine Golston. Ms. Golston? You and your family is with you as well?

      Ms. Golston: Yes.

      Mayor Glover: Would you all join us also? Chief.

      Councilman Shyne: Mr. Mayor, where do they live?

      Mayor Glover: Where do they live?

      Councilman Shyne: Right.

      Mayor Glover: These happen to be home folks.

      Councilman Shyne: Alright. Where is that? Cooper Road?

      Mayor Glover: Well, that’s what those of us who are natives refer to it as.

      Councilman Shyne: Alright.

      Mayor Glover: Neophytes refer to it as Martin Luther King Drive area, but for us who are natives, it’s the Cooper Road.

      Councilman Shyne: Alright.

      Mayor Glover: This is just simply an outstanding young lady, and I know that her family is so very proud of her Mr. Chairman and members of the Council. Ms. Catherine Golston is a Shreveport citizen who loves her fellow man, and that was shown in a heroic lifesaving act that she performed on the 27th of July. She was driving by the 2700 block of Phelps Avenue, which is adjacent to where I attended elementary school, North Side Elementary, and she noticed a fire on the front porch of a home. Rather than just simply continuing to go on her way, Ms. Golston jumped out of her car, grabbed a water hose and began to put out the fire. But she quickly noticed that not only was the porch on fire, but unfortunately a person was on fire as well. She doused the man until the fire was completely out, she then called 911 and stayed with the man until the fire department arrived. The man was in serious critical condition and was released from the hospital, just this past week. He had suffered a seizure while smoking on the porch. He fell unfortunately on his cigarette, and it ignited his clothes. Without a doubt, had it not been for the quick action and compassion of Catherine Golston, the man would not have survived. The gentleman’s daughter is Shreveport Police Officer Kimberly Washington. Officer Washington, are you here with us today? Please join us also.

      Councilman Shyne: I know Kim is happy.

      Mayor Glover: And as another part of this story that is not a part of my notes, but I was also told that once the situation was well in hand, that Ms. Golston did not even bother to stay around to receive any recognition or accolades, she just simply got back in her car and went on her way as soon as she was assured that the gentleman was safe and secure. So, she was not looking for or seeking any flowers or recognition, but obviously, at the suggestion of the Chief, who made me fully aware of this situation, we knew that this act of bravery and compassion and concern for her fellow man could just simply not go unacknowledged or unrecognized. And at this point, Chief.

      Chief Cochran: Thank you Mayor, Ms. Golston is a testament of that scripture, Greater love has no (inaudible) than to risk, let me paraphrase that, risk their lives for another. She demonstrated that. Firefighters and police officers work under that banner as a calling on our profession, but there are honorable citizens that do the very same thing. So, on behalf of Mayor Cedric Bradford Glover, and on behalf of all the brave and heroic men and women of the Shreveport Fire Department, we want to recognize her with one of the highest honors that we have, the Citizens Commendation. And it’s presented to Ms. Catherine Golston to recognize your lifesaving actions on July 27, 2007, when you saw a fire under a porch on Phelps Avenue, you stopped to put it out to prevent further damage. As you approached, you found a person on fire. Your willingness to help and your quick actions in extinguishing the fire saved the man’s life. Thank you for your willingness to become involved. And it’s signed by me, Kelvin J. Cochran, Fire Chief. And we also want to give you another rare honor to a citizen of Shreveport, and the Commendation Coin of the Shreveport Fire Department. We’ve very, very proud of you and grateful that you risked injury to yourself to save another fellow citizen. Could we all give her a round of applause.

      Mayor Glover: We also have couple of other presentations to make as well. Ms. Golston, you also receive this Mayor’s Award of Excellence as well, and this pin, which officially dubs you as Honorary Deputy Mayor.

      Councilman Shyne: Wow!

      Mayor Glover: And before we do that, Officer Washington, would you like to make some comments on behalf of your father and your family?

      Officer Washington: Well, first of all, words cannot express what she’s done. The only thing I can say is thank you. Thank you.

      Ms. Golston: I would like to say thank you, all of you all. And I’d like to thank God for giving me the courage and the strength to stop by and to do the things that I needed to do as a woman and as a mother. Because that was somebody’s husband, and father. And I hope that my children follow in my footsteps and do the proper thing. Thank you.

      Mayor Glover: Certainly a hero.

      Councilwoman Bowman: She’s a “Shero”.

      Councilman Lester: There you go.

      Councilman Shyne: I knew Joyce was going to say that.

      Councilman Lester: Mr. Mayor, wouldn’t you say that, that ends this myth that some people have that nothing positive comes from the Cooper Road, and people on the Cooper Road don’t have positive family values? I think that would - - -

      Mayor Glover: Well, for those of us who are natives thereof know that that is a myth, that unfortunately is perpetrated by those who don’t know any better. But yet another fine example of the wonderful people who populate all of this wonderful city and particularly our neighborhoods.

      Councilman Shyne: That’s right.

      Mayor Glover: Absolutely. And lastly, and I’m not sure if we have a recipient here today. If we have anyone who is here today with the ‘Start Heart Health Walk Day’? Is she here? How do you do? Nicole?

      Ms. Smith: Yes sir.

      Mayor Glover: Well alright, with the American Heart Association?

      Ms. Smith: Yes sir.

      Mayor Glover: Wonderful. It is my abundant privilege to present this proclamation which will proclaim this Saturday, the 13th of October ‘Start Heart Health Walk Day’ in the City of Shreveport. And it commemorates - - - is this - - - which one? The first or second, the third, the tenth?

      Ms. Smith: Actually, we don’t know. There’s been so many of them here.

      Mayor Glover: Well we’re going to consider this the ‘Inaugural Start Heart Health Walk Day’ on this coming Saturday. And the particulars are it will be where Nicole? Why don’t you share that with us.

      Ms. Smith: It is actually at the Louisiana Boardwalk at 8:00 in the morning, we’ll get our festivities underway, and this actually the first year for the ‘Start Wellness Program’, behind the Health Walk and basically our goal is to get Shreveport, Bossier, and our outlying communities involved with year round wellness. We want everyone walking.

      Mayor Glover: Wonderful. Well, we will start this coming Saturday at 8:00 at the Louisiana Boardwalk observing the 1st Annual Shreveport/Bossier City Heart Walk Day, and declare this coming Saturday, the 13th of October, to be that particular day. So, Nicole, thank you so very much, we look forward to many, many years to come.

      Ms. Smith: Thank you Mayor Glover. Can I take just one second of your time?

      Mayor Glover: Certainly, without question.

      Ms. Smith: I do want to thank again, the Shreveport Fire Department today. This past Saturday, they conducted what we called the golden hour. And it was headed up by Captain Frederick “Hank” Williams, who is a heart attack survivor. He almost lost his life at 39 years old from a heart attack. And I cannot thank the Shreveport and Bossier City Fire Departments enough for getting out there on the street and shaking the boot for about one hour on Saturday. They were able to raise about $5600 in one hour by taking their time, during their workday of saving lives to help save lives in our community to prevent heart disease and stroke. So, we thank them again.

      Mayor Glover: Thank you. I want to join you Nicole in thanking Tank for taking the lead in helping to get the Fire Department mobilized for this worthy effort. Tank happens to be my neighbor. He’s a great guy, and is doing a great work. And I happen to catch the guys at the corner of Pines Road and Jefferson Paige Road, that I think right about noon on Saturday. So we helped to contribute to that $5600. Thank you so much. And lastly before I take my seat, I want to thank Mr. Chairman, you and all the members of this Council for having the sensitivity and the appreciation for the life and the work and the contribution of our former Congressman, Joseph David Waggonner, Jr. in agreeing to postpone the start of today’s Council Proceedings from our usual 3:00 start time to 4:00. I and several of you had the opportunity to be there today and it was a very appropriate and touching recognition of a many who contributed a great deal to Northwest Louisiana. And I want to just simply read into the official record a poem that Congressman Waggonner asked be read today. And have that be this Administration’s tribute to all of the work that was put forth by Congressman Waggonner and the poem is entitled “The Bridge Builder”

            An old man traveling a long highway,

            Came at the evening cold and gray.

            Toa a chasm vast and deep and wide.

            The old man crossed in the twilight dim,

            The sullen stream held no fears for him

            But he turned when safe on the other side

            And builded a bridge to span the tide.

            “Old man,” creid a fellow pilgrim near,

            “You’re wasting your time in building here.

            Your journey will end with the closing day;

            You never again will pass this way.

            You have crossed the chasm deep and wide,

            Why build you this bridge at even-tide?”

            The builder lifted his old gray head;

            “Good friend, in the path I have come,” he said

            There followed after me today

            A youth whose feet must pass this way.

            This stream which has been as naught to me,

            To that fair-haired youth may a pitfall be.

            He, too, must cross in the twilight dim-

            “Good friend, I am building this bridge for him.”

      Mayor Glover: Those words, I think are as fitting of a tribute to the life and legacy of Joe D. Waggonner, as I could manage to offer. So, thank you, God bless him, and God bless his memory. Thank you members of the Council.

      Councilman Walford: Thank you Mr. Mayor. Does any Council Member have a distinguished guest? Okay Mayor Glover?

      Mayor Glover: Yes sir Mr. Chairman.

      Councilman Walford: Was there a presentation planned by the Shreveport Fire Department.

      Mayor Glover: Yes, we do have yet another item. It’s not on my official agenda, so there will be lashings that will come after the Council Meeting for my staff for not having my agenda in appropriate condition. So at this point we have a proclamation and as skit. Skit is first. Chief?

      Councilman Shyne: Good. I want to see that Mr. Mayor.

      Chief Cochran: Mayor Glover and members of the Council, this month we’re celebrating Fire Prevention Month. On last year, the Shreveport Fire Department, the City of Shreveport had a distinct honor of celebrating “0” fire deaths in the history of our city.

      Councilwoman Bowman: All Right!

      Chief Cochran: This year, and that is due to just accumulative years of support from our elected officials and our citizens and the diligence of the men and women of the Shreveport Fire Department’s Fire Prevention Bureau and our firefighters to make that happen. This year at this point in the year, we’re on track to do the same thing two years in a row. One of our heroes and the greatest star of our Public Education Program is with us today, and he has been on the road for quite some time, and is soon to be nearing the period where he’s going to sign up on the drop. But Pluggy! Please say hello to the Council and tell everyone the significance of this week.

      Pluggy: Hello everyone. I am Pluggy and this is Fire Prevention Week, a week for safety learning.

      Chief Cochran: Well Pluggy, tell them about our theme that we’re trying to get across to our citizens this week.

      Pluggy: Well this week, is practice your escape plan.

      Chief Cochran: Very good. And tell them why it’s so very important to emphasize fire safety in our community.

      Pluggy: Because everyone needs to know about fire safety.

      Chief Cochran: Well Pluggy, tell the Council what are some of the safety features we teach our boys and girls when visit them in their schools.

      Pluggy: We teach about (inaudible) smoke detectors, not to play with matches and lighters, and to have a home escape plan.

      Chief Cochran: Very good. You’re passing the test. Now tell the citizens and the children what are the three most significant things that they should recognize about fire safety so that we’ll end the year with “0” fire deaths.

      Pluggy: Well Chief, first the boys and girls should have escape plan. And second they should practice their escape plan, and third and final is maintain their smoke detectors.

      Chief Cochran: Is there anything else Pluggy, that you need to tell the citizens before we turn it back over to Mayor Glover?

      Pluggy: Yes sir. Remember when you change your clocks back an hour on October 28th, also remember to change your smoke detector battery.

      Chief Cochran: Very good Pluggy. We’re very proud of you. We’ll turn it back over to Mayor Glover. Could you say hello to Mayor Glover?

      Pluggy: Hello Mayor Glover.

      Mayor Glover: Hello Pluggy, how do you do?

      Pluggy: I’m doing excellent.

      Mayor Glover: Now there are lots of folks in this chamber who are not sure if you can move. That’s what I was about to.

      Pluggy: Well, my wheels were spinning.

      Mayor Glover: They were spinning?

      Pluggy: Yes sir. I also would like to have some 20 inch chrome wheels.

      Mayor Glover: We’d have to make you a lot taller.

      Pluggy: That’ll work!

      Mayor Glover: As long as you didn’t want any kind of base amplification installed, we’d be okay.

      Pluggy: Base amplifier, I’d like that.

      Mayor Glover: We can put you on dubs, we just can’t give you any base. But now Pluggy, I want to present to you and to the Chief and to all of the members of the Shreveport Fire Department, this proclamation which proclaims the 7th of October to the 13th of October as Fire Prevention week, and we want to encourage all of the men and women, boys and girls, and families throughout Shreveport, Bossier City, and Northwest Louisiana to do just as you’ve just instructed, to make sure that they have a fire safety plan, that they practice that plan, and be prepared to use it in the event that it’s needed. So we can yet again celebrate a year with “0” fire deaths in the City of Shreveport. So, Chief on behalf of you and all the outstanding men and women of the Shreveport, it is my honor to present to you this proclamation. And thank you Pluggy, thank you members of the Council.

      Councilman Walford: Mr. Mayor and Chief, if I could get you back up here, if I’m not mistaken, isn’t this the 170th anniversary birthday of the Shreveport Fire Department?

      Chief Cochran: That’s absolutely right. This month we’re celebrating the 170th year of the beginning of the organization of the Shreveport Fire Department.

      Councilman Shyne: And Chief - - -

      Councilman Walford: Wait a minute Mr. Shyne, I’ve got one more question. I was going to ask do you know if Mr. Shyne was on the original Council when we - - -? Go ahead Mr. Shyne.

      Councilman Shyne: Monty that was not fair. That was not - - - Joyce (inaudible).

      Chief Cochran: Well, the answer is yes he was. And he was one of the reasons we started off as a fully career fire department.

      Councilman Shyne: I was just about to say - - -.

      Councilman Walford: But I got you flustered whatever you were going to say.

      Councilman Shyne: You sure did. I was about to say, I believe Chief Dallas Green must have served as Chief for about 100 years, didn’t he? I hope he’s watching this. I hope he’s listening in.

      Chief Cochran: I’m sure he is.

      Councilman Walford: Chief, I think I can speak for all of us in saying we’re certainly proud of our Fire Department.

      Chief Cochran: Thank you, and thank you for your support.

      Mayor Glover: Mr. Chairman, I can confirm the rumor that Councilman Shyne did donate the first Dalmatian, the official mascot and fire dog for the Shreveport Fire Department. So, I don’t know if he was on the Council, but I do know he was around and in a position to make sure that the first firehouse had a good quality fire dog to be able to be there to work with the fine me of the Shreveport Fire Department back in those days.

      Mr. Thompson: And he hasn’t donated anything since.

      Councilwoman Bowman: Way to go Art!

      Mayor Glover: I think you’re right. I think he writes that one off from year to year. Thank you Mr. Chairman. Thank you members of the Council.

      Councilman Walford: Thank you Mr. Mayor. Trying to return to some sense of decorum, we move - - -

      Councilman Long: Mr. Chairman, I think we might make Joe a new “Pluggy” some day.

      Councilman Walford: Property Standards Report we had yesterday, but does anyone have any questions for Mr. Holt?

      Councilwoman Bowman: I have one.

      Councilman Walford: Mr. Holt, you didn’t escape sir. Ms. Bowman?

      Councilwoman Bowman: Yeah, I got this call from one of the citizens that lives in my district, and she has a problem with 2828 Metal Street, and she said that the house was basically abandoned, and there were no windows and no doors, however, there is somebody that’s been living in there, and they started a little fire the other day, and she called and reported that, but she has been seeing this person actually staying in that abandoned house. I’m not sure if the City owns the property, or what. But with it being in that area, and without any windows or doors, I feel something - - -

      Mr. Holt: Did you say Metal or Meadow?

      Councilwoman Bowman: M E T A L.

      Mr. Holt: See what we can do to get it secured.

      Councilwoman Bowman: She said he cooks on the grill or whatever, but - - -

      Councilman Long: Jim, I reported a while back an issue over on I think Magazine Street, if you can give me an update on that, I’d appreciate it. In the 3800 Block and also I got a call from a citizen over on - - - who lives over on Willard, she is reporting that there is an abandoned house over in the 6400 block of Henderson, maybe 6425 that she’s seen some drug activity as well as, and which I’ve already reported that to my CLO, but that house is abandoned and open and just out there. We need to find out what the status is so that we can possibly initiate a - - - some action.

      Mr. Holt: Yes sir.

      The Clerk read the following:

      1. Resolution No. 160 of 2007: Authorizing the Mayor to sign an agreement between the City of Shreveport and BKD, LLP for an external audit of the City of Shreveport for fiscal year January 1, 2007, through December 31, 2007, and otherwise providing with respect thereto.

      Read by title and as read, motion by Councilman Long, seconded by Councilman Webb to adopt.

      Councilman Long: I think we’ve got everything under control with Julie on the contract on the language of the agreement.

      Ms. Glass: Yes. What you’re approving right now is simply the agreement that ties together the engagement letter, the RFP, their proposal, and things like that. We have a few minor things to work out on the engagement letter, but other than that, that’s basically what you’re doing.

      Councilwoman Bowman: Yesterday Councilman Long as the Chairman of that committee, if they had a copy of that information.

      Ms. Glass: The agreement is linked on the agenda. The engagement letter is not finalized. So that’s why we did not link it.

      Councilwoman Bowman: So there won’t be anything different for us to look at before I vote on it. That’s what I’m saying. I’m not expecting to see anything any different than what’s on here when I - - -

      Ms. Glass: That’s correct. What you’re voting on is the agreement that allows the Mayor to sign it, that ties together those things. You’re not voting on the content of the engagement letter. If you wanted to do that, you probably need to postpone.

      Councilman Lester: Just for clarification, what if anything additional, does the engagement letter add to the agreement and the process?

      Ms. Glass: It adds a few things that are kind of procedural for example, one of the issues that we are disagreeing on at this point, is they added in a provision that we would go into mediation in the event of a disagreement. There is a provision that we asked them to take out that said that the engagement letter is the entire agreement, which obviously it’s not because the RFP and their proposal are significant part of the agreement. So, it’s various things like that. And one of the issues is whether we can use their audit when we do public bond offerings. So it’s things like that.

      Councilman Lester: Do you have a timetable for the expected completion of the engagement letter?

      Ms. Glass: We’re really down to just the mediation issue I think, so I don’t expect it to be a long time. If Council is not comfortable on voting now, Leanis do you think it’d be a problem if they were to postpone or, you know that would be in the Council’s discretion.

      Councilman Walford: Any other questions?

      Councilman Lester: No, I don’t have any other questions. I just think certainly I support the recommendation of BKD, I was on the committee, supported the findings of the committee. I think Ms. Bowman raises a legitimate point that if the agreement is not complete, then I don’t think it would be the most prudent thing for us to do, to vote a contract that’s not complete.

      Ms. Glass: That’s certainly in your discretion. I think we have time to get it worked out.

      WHEREAS, Harvey Lee Christian and Geraldine Bowman Christian were the owners of record of Lot 4, Page Bayou Subdivision, Unit 1, Caddo Parish, Louisiana, as per plat recorded in Book 650, Page 95, of the records of Caddo Parish; and

      WHEREAS, the City of Shreveport granted a Permit to Encroach on Cross Lake on the above described property to Harvey Lee Christian and Geraldine Bowman Christian pursuant to City of Shreveport Ordinance No. 83 of 1995, by instrument recorded February 8, 1996, and recorded as Registry No. 1503699 in Conveyance Book 3094, Page 245, to accommodate the improvements already located thereon owned by Harvey Lee Christian and Geraldine Bowman Christian (Exhibits A and B); and

      WHEREAS, Geraldine Christian predeceased Harvey Christian and, pursuant to the Judgment of Possession of the Succession of Geraldine Christian by instrument recorded October 27, 2004, and recorded as Registry Number 1945323 in Conveyance Book 3717, Pages 410-411, Harvey Lee Christian became the sole owner of record of said property; and

      WHEREAS, subsequent thereto, Harvey Lee Christian passed away and, pursuant to the Judgment of Possession of Harvey Christian by instrument recorded August 3, 2006, and recorded as Registry Number 2050818 in Conveyance Book 3876, Pages 698-699, Dennis Wayne Christian is the owner of record of said property; and

      WHEREAS, a request has been received from Dennis Wayne Christian for an encroachment in and to a portion of the public right of way as depicted on the plat attached hereto and made a part hereof, to accommodate the improvements already located thereon when owned by Harvey Lee Christian and Geraldine Bowman Christian; and

      WHEREAS, the proposed encroachment upon public property is not adverse to the public interest of the citizens of the City of Shreveport; and

      WHEREAS, Dennis Wayne Christian promises that if the encroachment is granted, he will not construct any additional improvements on said property; and

      WHEREAS, the instrument or Permit to Encroach shall provide for the payment by Dennis Wayne Christian to the City of Shreveport of $300.00 for the encroachment;

      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shreveport, in due, legal and regular session convened, that it hereby authorizes the Mayor’s signature on the Permit to Encroach and Dennis Wayne Christian shall be bound by all provisions of the Permit to Encroach, as well as this Resolution, and, after due notice thereto and after the effective date of this Resolution, the Mayor of the City of Shreveport is hereby authorized and empowered to execute and deliver, for and on behalf of the City of Shreveport, an instrument or Permit to Encroach substantially in the form of the document filed along with the original copy of this Resolution in the Office of the Clerk of Council on September 14, 2007, attached hereto as Exhibit C. Provided further, the instrument of Permit to Encroach shall provide for the payment by Dennis Wayne Christian to the City of Shreveport of $300.00 for the encroachment.

      RESOLUTION NO. 172 OF 2007

      A RESOLUTION OF THE CITY OF SHREVEPORT TO ACKNOWLEDGE, REMEMBER AND PAY TRIBUTE TO THE LIFE OF JOSEPH DAVID WAGGONNER, JR

      WHEREAS, Joseph David Waggonner, Jr., known to friends and colleagues as “Joe D. Waggonner”, died on October 7, 2007, at the age of 89; and

      WHEREAS, Joe D. Waggonner, Jr., was first elected to public office in 1954 and continued to serve in a number of elected public offices throughout his lifetime including sixteen (16) years as a U. S. Representative in the former Fourth Congressional District of Northwest Louisiana; and

      WHEREAS, during his tenure as U. S. Representative, Joe D. Waggonner, Jr., served as a member of the House Ways and Means Committee, and used his influence to secure major funding for several projects that significantly impact Northwest Louisiana today, including the Red River Waterway, Interstates 49 and 220, La. Highway 3132 (Inner Loop), the Port of Shreveport-Bossier, and the General Motors plant in Shreveport; and

      WHEREAS, Mr. Waggonner’s accomplishments on behalf of this State and this region have been recognized by re-naming the “Red River Lock and Dam” the “Joe D. Waggonner Lock and Dam” as well as the creation of the “Joe D. Waggonner Scholarship in Engineering and Science” at his beloved Louisiana Tech University in Ruston, Louisiana; and

      WHEREAS, Mr. Waggonner’s achievements on behalf of all citizens of Northwest Louisiana have earned him a place in Louisiana history and his induction into the Louisiana Political Museum and Hall of Fame in Winnfield, Louisiana.

      NOW THEREFORE BE IT RESOLVED that the City Council of the City of Shreveport officially recognizes the many accomplishments of the Honorable Joseph David Waggoner, Jr., and acknowledges that these accomplishments have been major contributions to the growth and development of the City of Shreveport and all of Northwest Louisiana.

      BE IT FURTHER RESOLVED that the City Council remembers and pays tribute to the life of the Honorable Joseph David Waggoner, Jr., a dedicated, committed and true public servant; and the City Council expresses deep and profound sympathy to his family.

My question is I see that the affect of this would be to increase the fund by a figure of about $213,000, but we are decreasing liability reserves by $1.839(million). Is this to pay some unanticipated claims? Is this to pay one particular claim? Is this at the end of the year, we’re paying all of them in an amalgamated form or what?

      Ms. Washington: It’s simply to bring the budget up to where we think we’re going to end at 12/31.

      Councilman Lester: So, this is an approximation based upon the litigation that’s already ongoing?

      Ms. Washington: Some of it may not actually be litigation, but claims, expenses.

      Councilman Lester: Okay, okay - - - alright. That answers that question. Thank you Ma’am.

      Councilman Lester: I know that when we’ve done some of these things, relative to organizations and things of that nature, one of the big issues that we have is notice, and giving the proper information to the people that are going to be affected by it. And I guess my questions is what efforts do you anticipate, or does the Council anticipate in terms of public education for those people that are in the business of soliciting funds on a regular basis? What kind of notice are we giving - - -?

      Councilman Walford: I was going to ask the Police Department, since they’re handling the permits to just as part of the permit process, to provide this. And really, I mean we’re talking two major items. Wearing the safety clothing, and don’t get over aggressive and knock on windows. But I think that the Police Department can handle that for us, and I’m sure Kacee could do a press release if necessary. But I think just telling the organizations when they get their permits. Mr. Webb, you had a question?

      Councilman Webb: Yes, I was looking at subsection C here, where it says they can’t solicit on the streets where the speed limit is in excess of 35 mph.

      Councilman Walford: Yes sir, but that’s not part of the amendment. I think the amendment basically addresses the other items. If I’m not mistaken, that’s been a part of the ordinance. I think the idea there is to keep ‘em off of Bert Kouns and some of the busier streets, but that’s not new. That’s part of the existing ordinance.

      Councilman Webb: So, what do they do? They have to get special permission from the Police Chief to - - -

      Councilman Walford: They don’t do it. Our ordinance as it’s written right now prohibits that. Ms. Scott? Can you help me here.

      Ms. Scott: Actually both of you are correct. The current ordinance does provide that they are not allowed to solicit on any street in which the speed limit is more than 35. But if memory serves correctly, this provision that says except as otherwise provided permitted by the Chief of Police or words to that affect. The only thing the ordinance does is as Mr. Walford says, is to add a requirement that the groups that are soliciting actually wear brightly colored vests, either yellow or orange with their names on it, and it also prohibits them now from tapping on windows to gain the drivers’ attention while trying to solicit funds.

      Councilman Walford: Mr. Long, you have a question?

      Councilman Long: No, I don’t have a question. I just need to make a statement. I’m supporting these amendments as they stand right now, but I, in the future I’m going - - - I would like to see this practice go away completely. I still think it is a major safety issue for the people who are doing it, for the drivers that they solicit. I don’t like it, I think it makes our streets in our city look trashy, and I will work in the future to try to remove this completely. But I just have a real problem. Thank you.

      ORDINANCE NO. 152 OF 2007

      AN ORDINANCE TO AMEND AND RE-ENACT CERTAIN PROVISIONS OF SECTION 42-325 OF THE CITY OF SHREVEPORT CODE OF ORDINANCES RELATIVE TO CHARITABLE SOLICITATION OF FUNDS AND TO OTHERWISE PROVIDE WITH RESPECT THERETO

      BE IT ORDAINED by the City Council of the City of Shreveport, in due, legal, and regular session convened, that sub-sections (b), (c), and (d) of Section 42-325 of the City of Shreveport Code of Ordinances are hereby amended and reenacted to now read as follows:

      Sec. 42-325. Solicitation of funds and distribution of literature by religious organization, charities and philanthropic institution; permit required.

      ***

      (b)  After fulfilling the permitting and notice requirements in subsection (a) of this section, the person desiring to solicit funds or distribute literature or merchandise shall be permitted to carry on such activities within the city daily from 9:30 a.m. until sundown; provided however, that nothing contained in this section shall be construed to permit any person to solicit funds or distribute merchandise on commercial or industrial property, at fairs, festivals or other public events, or on public or private property, without first securing permission to do so from the owner or possessor of such property, or the sponsor of such fair, festival or event. All persons soliciting funds or distributing literature or merchandise for a religious organization, charity or philanthropic institution shall wear an orange or yellow colored traffic safety vest with the name of the organization clearly identified and legible by a driver or passenger in a motor vehicle.

      (c)  Any solicitation of funds or distribution of literature or merchandise authorized by this section which is undertaken on the public streets of this city or where the drivers of motor vehicles operated on the streets of this city are solicited for funds or given literature or merchandise shall occur only during daylight hours and shall not at any time be conducted on expressways, parkways or major arterial streets as defined in the subdivision rules and regulations adopted by the metropolitan planning commission or on any street where the speed limit is in excess of 35 miles per hour. Provided, however, the chief of police may establish criteria, with the approval of the mayor, for waiving the requirements of this subsection (c), and may waive such requirements for persons and organizations meeting the criteria. Moreover, no person soliciting funds or distributing literature or merchandise for a religious organization, charity or philanthropic institution shall tap or knock on the window of any motor vehicle in an attempt to solicit funds or distribute literature or merchandise, nor shall any such person obstruct or hinder the flow of traffic at any time while engaged in such solicitation of funds or distribution of literature or merchandise.

      (d)   Any person found in violation of any provision of this section shall be punished as provided in section 1-14 of this Code.

      BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this ordinance which can be given effect without the invalid provisions, items or applications and to this end the provisions of this ordinance are hereby declared severable.

      Councilwoman Bowman: Mr. Chairman, reminder of the Public Safety. Councilman Shyne, the Public Safety Committee Meeting is going to be October 16th. Remember that.

      Councilman Walford: Would you send him an email to remind him?

      Councilman Shyne: Monty, you’re being messy.

      Councilman Long: Joe, you got any pigeons?

      Councilman Shyne: Mike, you’re being messy too!

      Councilman Webb: What time are you going to have it Joyce?

      Councilwoman Bowman: 1:45 right?

      Councilman Walford: I do want to make one committee assignment or task force assignment. The Council some time ago asked Mr. Lester’s legislation to create a wireless task force or study task force, and we have not made our appointments to that yet, so I’m appointing Mr. Lester and Mr. Wooley both at their request to serve on that task force, and as soon as we work out joint wording with the Caddo Parish Commission, I’ll come forward with a resolution for our joint City/Parish Committee. But I think the two resolutions should (inaudible), so I will work with the commission for that.

      Councilwoman Bowman: Mr. Chairman, before you do that, in reference to what you just said, the resolution? When you speak with Commissioner Pierson, Parish President, can you all include the School Board in that?

      Councilman Walford: you know that was brought up at the meeting, but I didn’t ever think that that part of it - - - when I walked out, my understanding was the Joint Parish City Committee, and certainly we can go ahead with that committee and address the other. But I will talk to him and see what the Commission’s feelings are. You might want to present that to the Commission as a whole.

      Councilwoman Bowman: Thank you.

      Councilman Walford: But you do recall that was discussed.

      Councilwoman Bowman: I left before that.

      Councilman Walford: Okay, but it was discussed, but the last thing that was said, was to create the committee of City and Parish. They didn’t - - - and again, that was an unofficial request.

      Mayor Glover: Mr. Chairman, not to dispute or contradict, I do though believe that it was also agreed that certainly the School Board would be invited to participate in the next meeting. Now how the whole thing would be structured, I’m not quite sure, but I do know that there are certainly an interest and a desire to have the next gathering be inclusive of the members of the School Board.

      Councilman Walford: Again, that was discussed, but the request to me was three members of the Council to serve on a Joint Commission/Council Committee. And in my discussion with Mr. Thompson, we felt like it was best to have the same wording for the two resolutions to create that. But I will certainly address that with Mr. Pierson, and if that’s the pleasure of the Council and the pleasure of the Commission, then certainly they will include members of the School Board in that committee.

      Councilman Shyne: Mr. Chairman, I just wanted to commend you for your appointments to the committee. You appointed two young, energetic and very competent Council people to serve on that committee. And both of them seem to have a tremendous amount of interest in high tech. So, I just wanted to let you know that I think you made excellent choice.

      Councilman Walford: Thank you Mr. Shyne, and I want to tell you that I agonized over that, even though each had requested, because they both are very technically savvy, and I thought perhaps you had wanted to serve on that committee, but you never mentioned it to me. I waited, and that’s why we’ve been so long sir. But finally Councilman Lester pushed me to the point that I had to go ahead and make the assignments. I just knew you’d have your notebook computer ready to go.

      Councilman Shyne: Bryan, I’m not going to say anything.

      Councilman Walford: How about we move to Clerk’s Report.

      Mayor Glover: Mr. Chairman?

      Councilman Walford: Mr. Mayor.

      Mayor Glover: Before you move to Clerk’s Report, and get into the Committee of the Whole, I want to just express the Administration’s interest in working with the Council with regard to the wireless issue. One of the things we spent time over the last ten months or so, is doing quite a bit of research with regard to the issue of municipal wireless. There are some varying thoughts on the issue as a whole. One of the things that I definitely think would be of great benefit to our city however, would be if we were to at least start with our downtown as an area where we could come up with a municipal wireless system that our citizens, business folks would be able to access and what have you, if we had some ideas in that regard, we definitely look forward to having the opportunity to talk about and share those with the Council, and I think especially in light of the current status with regard to Cyber Command, it’s provisional status, hopefully, it’s coming permanent status, that the ability of our city to be able to offer access to a municipal wireless system would be something that lends itself to further opportunities, both in terms of an economic standpoint as well as attracting people to our downtown area, and to our city as a whole. So, we look forward to working with you all on that. And I also wanted to make this comment while we’re still in our regular agenda. And that is, I want to thank Shelly Ragle and all of the folks with Parks and Recreation for yet another outstanding effort with the Red River Revel. Started off with Emily Lou Harris, and a great event. A great number of stars and local folks who participated. Had a wonderful email from one of the musicians involved in Emily Lou’s band, who talked about how wonderful the City of Shreveport is. And in fact said that the folks from Nashville, which is where this young man happens to be from, should travel to Shreveport to really learn how to put on a great festival. And ended the week with George Clinton and the Funkadelics and the P Funk All Stars on Saturday night. And for those who don’t yet have their “Bop” guns, maybe they’ll go get them after hearing George Clinton and the ladies and gentlemen that he partied with there on Saturday night, but it was a great effort. The weather cooperated and Kip Holloway and his folks also obviously and his board provided the leadership and the vision and Shelly, you and your folks were there every step of the way to make it, yet again, another signature event for Shreveport. So, thank you and let your folks know that we’re very proud of the work that they put forth.

      Councilman Walford: And Mr. Mayor, I’m going to ask Councilman Lester to help me, I don’t remember the exact wording of the legislation, but the Administration is included on that task force.

      Councilman Lester: Yes, yes.

      Councilman Walford: So, you will have representation on there again. Memory doesn’t serve me for exactly who or how many, but your office is certainly included.
