COUNCIL PROCEEDINGS OF THE CITY OF SHREVEPORT, LOUISIANA

AUGUST 27, 2002

    The Regular Meeting of the City Council of the City of Shreveport, State of Louisiana, was called to order by Chairman Roy Burrell, at 3:15 pm., Tuesday, August 27, 2002, in the Government Chambers in Government Plaza (505 Travis Street).

    Invocation was given by Councilman Serio.

    On Roll Call, the following members were Present: Councilmen Huckaby, Stewart, Carmody, Serio, Spigener, Shyne and Burrell. 7. Absent: None.

    Motion by Councilman Shyne, seconded by Councilman Spigener for approval of the Administrative Conference Summary Minutes of August 12, 2002 and the Regular Meeting Minutes of August 13, 2002. Motion approved by the following vote: Councilmen Huckaby, Stewart, Carmody, Serio, Spigener, Shyne and Burrell. 7. Nays: None.

    Awards, Recognitions of Distinguished Guests, and Communications of the Mayor Which Are Required By Law. Mayor Hightower: Councilman Serio, I want to thank you for mentioning Alvin in the opening prayer. It is one of the most shocking days, I think, any of us on this Council have experienced and I know it is for his co-workers and workers all around the City. You just never know what lies around the next corner, so I would hope that everyone in this City would keep him in our prayers. We wish him not only a recovery, but a speedy one, as well.

    The other thing that I would like to mention today is, Chief Roberts is with us today and quite often our citizens call on the public servants, whether they be in the Water Department or Police Department or the Fire Department to come to the rescue and we did have an incident a couple of weeks back that both police and fire personnel were called to a home to assist in what appeared to be a shooting at the scene.

    And I think it is important for all of us to understand and realize, we need the best people possibly on those trucks and in those cars when that fire bell goes off or that 9-1-1 call is made. And in order for us to maintain and keep those people on the payroll, we've got to pay them what it takes to keep them here. We can't continue to train and then let them go to other departments in Dallas or Longview or wherever they may chose to go because I can promise you, they get excellent training here and those departments around the country know they do, and they know that with the salaries that we are paying our guys, we are prime pickings. And that is the reason that you as City Council members and we as the Administration has stepped up to the plate along side the Police and Fire Departments to try to pass the sales tax in November and I think when you hear the story today, and you take a look at what happened to Alvin, and you take a look at what happens, again, every time that alarm sounds at a fire station or a 9-1-1 call comes into the Police Department, you understand quickly that a quarter of a cent is not too much to ask. So, with that, I would ask in November, for our citizens to go to the poll and take care of these people, with that, Chief.

    Chief Roberts: Mr. Chairman, it is with great pleasure today that I come before you to recognize, commend, and honor two Shreveport police officers for their heroic efforts on August 27, 2002.

    On this date, Officer Twana Moore responded to the 500 block of Oriole Lane regarding a shooting call. Officer Moore entered the residence, not knowing what to expect. She has total disregard for her own personal safety and charged into the residence to lend her support. She rescued a 1-year old girl from the arms of a suspect who was attempting to commit further harm to this infant. She moved the infant to a safe place within the residence and then placed the suspect under arrest and secured the scene.

    Also, participating in this event was Officer Dean Willis. He arrived shortly thereafter and rendered aid to two other gunshot victims in the residence. He immediately helped Officer Moore secure the scene for the Shreveport Fire Department Emergency Medical personnel.

    We are extremely proud of both of these officers as well as the Shreveport Fire Department for rendering emergency medical aid and I commend them all for a job well done. This is a very tragic event. One of the most tragic events I've been involved in and associated with during my career and we all need to remember to keep this entire family in our prayers every day. This is a very emotional event suffered by the Police Department, the Fire Department, as well as this family so it is very important that we keep them in our prayers. I would like to call up at this time, Officer Moore and Officer Willis.

    Officer Moore will receive the Departmental Commendation Medal and the Departmental Lifesaving Medal. Officer Willis will receive the Departmental Commendation Medal.

    I'd like to add, Barry and Connie Gerald (the family that suffered this loss) is in the audience today and they are here to support these two officers as well as the Fire Department, as well as LSU Medical Center, LSU Medical Staff and we have formed a bond with this family, so to speak, and we are very appreciative for their support and we are extremely appreciative that they took time out today to come honor our two officers. Thank you very much.

    Councilman Burrell: First of all, I'd like to extend the opportunity for the officers to make a comment if you would like, we always like to give you that opportunity. You are hardly ever in here to say anything to us, so get up and at least you can say something to us.

    Chief Roberts: Officer Moore is very shy.

    Councilman Burrell: I can't believe that, being out there with what she has to do or both of them have to do.

    Officer Moore: I want to thank the Geralds' for coming and supporting me. And like the Chief said, we have formed a bond and I hope everybody keeps them in their prayers, the whole family.

    Officer Willis: I just want to thank the Council and the Administration for taking the time to do this today. It is not just these types of calls that officers go out to and go above just what we have to do. We try to do it on every call that we make. And also to the Gerald family, thank you very much for allowing us to visit with you and bondwith you, that's helped us in dealing with this situation. And the greatest award out of all of this, is seeing that ya'll are putting things back together and getting through it, so God bless you.

    Councilman Carmody: I know that all of us have had our times to interact with the Police Department and I am not even sure if Officer Moore remembers, but she had conducted herself one time when I had called for services for a neighbor who is mentally disturbed and she impressed me then and still impressing me. And my hat is off to her as to her fellow officers and all of our Police Department. I am very proud of you.

    Councilman Shyne: I've always said that we have some of the best and brightest here in the City of Shreveport and this occasion brings about the truth in that.

    Chief, you, I like the image you are projecting today, you look good. This is the first time I've seen you with your jacket and shirt and tie on. I usually see you with your shirt and tie on, but you usually leave your jacket off, you look very professional today.

    Councilman Burrell: I would like to say on behalf of the Council to the Gerald family, we really appreciate you all being here and if there is anything that we can do on your behalf, please don't hesitate to ask us.

    Chief, I would like to make a comment to you. You weren't here when I had mentioned this, I believe on yesterday, but I want you to know, I know some times we always give a few lashings here and there. We don't always overly praise you, but I want to let you know that the people in District G and I know more than likely in F because they are adjoined at that point of Jewella and Greenwood Road, has sent back some positive comments about the traffic situation over there and I want to make sure that I pass that on to you.

    I don't know what you are doing, but keep it up. I know that we were talking there about the emergency vehicles that needs to, that actually need to have right-of-way. The situation that we have on Greenwood and Jewella is no way that we could have the right-of-way if emergency vehicles come through, because I've been there and saw our police cars as well as our emergency vehicles not being able to get through that traffic jam that they have there, so now the traffic is flowing for right now. Again, I don't know what you are doing, but keep it up. I appreciate what you are doing.

    Chief Roberts: Thank you Sir, I appreciate that. The officers are out there working hard.

    Awards, Recognitions of Distinguished Guests, and Communications of the Council.

    Councilman Burrell: I have some persons I want to recognize today, it just happens to be three Johns'. At this time, I would like to recognize some special people, that I consider special because they took the time out as well as spent their own money to try and give an experience to some of our young people in this City that really could use the exposure. One of these, I said, three Johns', it is coincidental they are all three named John, maybe this John deal may have something catchy about it there. But anyway I want to introduce you first to our first John is, John Martin.

    Mr. John Martin is the President of POCO (People of Color Outdoors). He isbringing a fishing tournament to Shreveport and normally we have a lot of fishing tournaments that are here now, but what is unique about this organization that they, as part of their community outreach, they reach into our communities to many of our poor children who don't get exposed to the fishing industry and put on an excellent fishing tournament this weekend just for them and paid it out of their pockets; so, Mr. Martin, if you would, he hails from Birmingham, Alabama.

    Mr. John Martin: I want to say one thing though, since we've been in Shreveport and Bossier City, we've had the best time of our lives. The most hospitality we've ever had in our life. The only time I have been to you guys state, whereas I've been to New Orleans quite a bit, my wife and I take vacation down there all the time, that is all I knew about Louisiana was New Orleans. So, we've been here about a week now, we will be here for another week. We've had our kids tournament. Everybody from the Mayor's Office to the Council's Office to Shreveport Streets Authority, been very helpful. We had a very successful youth tournament last week and our main tournament for our mayors is this weekend on the Red River. We expect about 300 fisherman from across the country to be here and we are looking for a great time again. But we had a great time here in Shreveport. And what we do with our kids is, we believe we should help someone. The Lord has blessed me and my company to be able to help some people and we believe that we should be role models and our motto is hooked on fishing and not on drugs and we try to provide a role model for our kids that can have a lot of experience and that makes you feel good, that's all I can say about the whole thing. I thank ya'll for all your support. John and the guys from the hatchery, they (inaudible) also to. These are the guys who made it possible, they helped me. I could not have made it without these guys.

    Councilman Burrell: John Gill and John Murrell they are our Cross Lake Inspectors from the DOS Department. Mike, you should be very proud of these guys. They worked very hard, all the way from baiting hooks to tying on lines to pulling off catfish and some of everything. I didn't know they were that talented.

    Mr. Martin: They were ver helpful. Councilman, I met John about three weeks. We sit down and I told him what I needed and he and his staff went to work and they pulled it all together and everything worked out, along with your help. We had a great time so far, so I say, thank you guys, thank you all.

    Councilman Burrell: I might add, we had over 400 youngsters there, that is not even including parents. And can you imagine maneuvering that many kids on those, its over at the Fish Hatchery, and maneuvering them around the bank when they were all exciting, I thought some of them were going to jump in the pool, but they maintained control and John, some of his anglers were there to help. Many of them there, even the parents had never gone fishing before and it was really a life changing experience.

    I was looking for the Mayor to get slapped by one of those big catfish that we were pulling out of there, because he was there and he had an opportunity to weight in some of the catches of these young people. It was so exciting to see many of these kids. The fish that they had in their bags, they had four or five, I think the limit was five (Mr. Martin: Five fish per kid.) and it looked like it weighted more than they did and theywere dragging the fish across, on the ground trying to make it up to the weighing station. I believe the bag weighed more than they did. But anyway, John, Mr. Murrell, would you like to make a comment and Mr. Gill.

    Mr. Murrell: We were very happy to serve in our capacity to make some childhood memories. I know some of the kids caught their first fish. And with their family there, I know they are going to have life time memories and we are just glad to be part of it.

    Mr. Gill: We would like to extend our thanks to Mr. John Martin and POCO and look forward to next year and everything to come.

    Mr. Martin: I'd like to invite all of the city officials out Thursday night to our annual banquet which will be at the Le Bossier motel at 7 o'clock in Bossier City and all the city officials and press are invited out and I thank ya'll for ya'll support.

    Councilman Shyne: Are you all serving catfish?

    Mr. Martin: No sir, we are not serving catfish this time, but we got lots of good food on the menu.

    Mayor Hightower: John, thank you and your group, all of the guys out there did a great job and we look forward to having you back next year.

    Councilman Burrell: I might add to that, they were able to dump about 5,000 pounds of catfish into the hatcheries over there and I'm sure 95 if not 100% of the kids had an opportunity to catch fish out of there. And matter of fact, I know there is some more over there and I just wanted to talk to Mike and see if I could come back over there and finish off the rest. . . .'can't do that, can I.

    Adding Legislation to the Agenda. (1) The Council added the following legislation to the agenda on motion by Councilman Serio, seconded by Councilman Shyne and approved by the following vote: Ayes: Councilmen Huckaby, Stewart, Carmody, Serio, Spigener, Shyne and Burrell. 7. Nays: None. Resolution 116 of 2002: A resolution suspending the effects of certain provisions of Chapter 10 relative to alcoholic beverages and Chapter 106 relative to zoning for property located at 6148 Bert Kouns Industrial Loop Expressway for a Castleberry Foundation Fundraiser on October 12, 2002, and otherwise provide with respect thereto. (2) The Council added the following legislation to the agenda on motion by Councilman Carmody, seconded by Councilman Serio and approved by the following vote: Ayes: Councilmen Huckaby, Stewart, Carmody, Serio, Spigener, Shyne and Burrell. 7. Nays: None. Ordinance No. 130 of 2002: An ordinance authorizing the donation of certain city-owned property to the Red River Waterway District and otherwise provide with respect thereto.

    Public Comments. Jimmy Cochran, Owner of Bikes Et Cetera. I have a business at 2503 Meriwether Road, Shreveport also at 2204 in Bossier City. I been in business for about 13 years in Bossier and about 2 ½-3 years here Shreveport. I am here in reference to the article in the paper today and I believe ya'll are going to come up to it about the skate boarders and bicycles and stuff in the City.

    I agree with some of the things in the article but what I am here for is to alsoencourage ya'll to 1) consider just trying to say you can't skate say at Kroger's where they've been run off before, skating here in Shreveport, parking lot after closing hours. Bossier City has done the same thing. Now, they have congregated, supposedly down here in the old town of Shreveport. And I understand the circumstances that was brought up in the paper but the solution is going to be, these are actually professional type kids. Since I've been in business, I bring a GT Air Show or a Giant Air Show to town and I have some photos I would like to pass around, if ya'll allow me.

    You will see babies, daughters, parents, kids in their 20's. My son is 22, we've been doing BMX racing and free-style tricks, like you are seeing in this photo, since he was 7-years old. These kids can make a living doing this thing.

    I've come before on some things here and to the City Council in Bossier. We need to build a skate park for these kids. There is a lot of grant money out there. Tyler, Texas, 2 or 3 years ago, spent $250,000 on a skate park that these kids, that can drive, as my son, will go to try not to be in trouble with the law here and stuff. They got $150,000 out of grants to help build a skate park and they allow the bicyclers. They are congregated all at once. They know where the kids are, they know when they have trouble. Most of these kids of today, have cell phone. If somebody is causing trouble, the right kids know when to call for help. I have some information that I pulled off the Internet just as quick as I could when I saw the article today.

    I am asking ya'll not to make a rash decision if you are going to vote and try to abandon these kids from here. I know tearing up property and these fountains is costing us money. We don't need to be repairing things that are a nuisance, but how are you going to determine when a kid is just down here riding late in the evening when low crowds, versus a kid that is here destroying your property? Most of these kids are good kids.

    I have two articles that I got off the Internet. One shows a lot about Tyler, Texas State Park. I will be glad to go with anybody and show them what they do there. Lincoln Parish Park in Ruston has a mountain bike park. They have a honor box. Most of the kids put money in there, so far as getting some of the fees back and stuff, it doesn't have to be mandated. And most of the kids, like my son and the people at my shop would run people off that tear it up. I would like to ask every one of you, this Sunday, we are having a dirt jumping contest at the Meriwether location. We have dirt ramps and all for the kids there, that I do at my own risk. I hope one day I can either put in either my own state park if I can't get city or state help, but I think it is something not just to come here and ask ya'll for it, but the Caddo Parish Commission, Bossier Parish Police Jury or all the City Councils get together, and build 2 or 3 small parks or one big park. They got articles on that kind of stuff about where it is better to have 2 and 3 throughout the City instead of one because half of the kids can't go there. You'll be surprised what these kids can do with very little income but it keeps them out of trouble if we will just provide it. And this a lot less money than any baseball or football organization that I have helped support for my kids and those sports. This is a, it is a lot of expense at first, but it is self-maintained if you build it right at the beginning.

    There is a company here that I have an article from, I was trying to get some answers back from them. I was going to see what it would cost for them to come here.They build most of the state parks across the country, they are out of Florida. I am going to see what they might would charge me if I could possible, at that time, come back to ya'll and ask ya'll to hear what they have to say and present how the go about helping getting the grants and everything to build these for us but before you make any kind of ruling just trying to say, we don't want you down here and all, I understand about some of the damages, but we need not to react, just: You can't come downtown no more. There is some people just ride down here because it is pleasant late at night. I've been with the kids, I know most of them and I am just here in a way, kind of defending them, but it is time for us as big as we have grown in the last 5 to 10 years, and we keep asking the kids, don't come to Clyde Fant Parkway, don't come congregate down here. We need to give them somewhere to go.

    If you want to see the type of kids, to realize they are good kids, please try to come Sunday afternoon and just see what we have to offer. This will be our third time to offer it, we've done it twice. This will be the second time at the Meriwether location. The pictures I am passing around are a professional team that I bring in every year.

    Councilman Burrell: Mr. Cochran to you have a census on the number of youngsters that participate in this sport in this area and do you have any type of census information?

    Mr. Cochran: No sir, I can get a lot closer to it, but I can tell you just like at the Cargill Park at the BMX race track that we have here, that you all have helped us with there. Out of state. We have a state championship coming up and you are going to have at least 100 kids racing for that state championship race. On a regular weekend, we have at least 25 somewhere up to 75 kids that just BMX race. This is a different type of sport with a bicycle, but they still do it on 20 inch bikes. But these kids, from skate boarders and all, you'll be surprised what's here in our area that are real good kids as far as highly performed and will possible be pros one day.

    Councilman Spigener: Very early this morning, I had a call from one of my constituents concerned about this very issue. I was just never aware skate boarding is as widespread of a sport and as many kids interested that she, in our discussion, enlightened me about a lot of issues about skate boarding and this seems to be a very fast growing sports.

    Councilman Burrell: You mean you didn't skateboard when you were coming up?

    Councilman Spigener: I really didn't and it was nothing that I really felt that I was to agile at doing and I . . . but anyway, I think this is a very valid endeavor here and a issue we might need to look into. But the first thing I would think about is liability and I guess that is the biggest issue that we would have to consider.

    Mr. Cochran: If we put it under some organizations, they do have their own insurance that helps take a lot of the liability risk out. Tyler like I say, they got signs everywhere basically just stating you are riding at your own risk. But you'll be surprised for instance, people like my son. The kids know when they come to Meriwether and ride our jumps, they will have their helmets and safety pads on or they won't ride and they pretty well. I don't have a lot of trouble. We ask them to come when we are there, not to ride when we are not there or they call and ask us, we are going. But togo out there late at night or something and have trouble. I wish some of the officers were still here that were here, they've been out there. Most people applaud for what my son has done at that location for the kids and I really wished, if ya'll have a little time Sunday afternoon, if ya'll would come out. I think ya'll would have a better respect of what I am trying to present and I hate to come with very little information, but I could get you a lot more, it is just the article hit me hard this morning and I wanted to come and let you know, we've got to provide somewhere for them to go and what usually happens, get real tough on them in the City, Bossier and Shreveport. We've run them out, say in the Parish and they do get hurt and then don't have very good response time to get help and these kids are professional about how they carry themselves.

    Mayor Hightower: Just to let the general public know that, SPAR and the Administration have both been looking at the opportunity to do skate board parks in particular, even in abandoned swimming pools. We sent off and received a lot of information on the different type ramps and so forth, so that is in the works, but our biggest predicament at this point, has been liability and what happens when we set up a park and it is not manned and something happens to somebody, so but just to let you know and the enthusiasts know, we are trying to work through those things. I know Shelley is here today and knows a lot about, Gary is out of town today, but we've talked, again about some swimming pools that we are having problems with as far as leaks and you know are just in disrepair but we've seen that happen around the country, so that you've almost got the built in ramps and you are down in a hole already, but tell them just to hold tight, we are going to try to work something out.

    Mr. Antee: Further on that, we are talking about two different issues. The people that he is talking about are not the people that this ordinance is aimed at. The people that this ordinance is aimed at, all you need to do is walk outside the front door and look to your right or our left and look at the damage and black and the torn up marble and concrete, that's what this ordinance goes at.

    We don't have the problems with these people and so we want to make sure we don't confuse the two issues and they are not just kids. I mean, there are adults out there that are on Saturdays we've run off down there that are ramping and going on the marble and chipping and tearing it up and tearing up the concrete that cost the taxpayers dollars. And I know you don't want that any more than we do because you are not associated with that group, but that is what the ordinance is aimed at.

    Councilman Shyne: I think Mr. Antee is exactly right. I have not seen him today, so that is why I call him Mr. Antee. Now when I see him, I call him Ken. This is the first time-I think is actually right in the evaluation because we are having damage that is being done not by the group that you are talking about and---I don't want to say a renegade group because I might be called a renegade sometimes and I don't know whether that is good or bad. But I think that is exactly right and I think this is what this piece of legislation is aimed at, that group that does a lot of damage that we can't afford to have but it is not aimed at, the group that you are talking about more or less, does this as a sport. And the other group kind of does damage downtown that we really don't need to have so I think this is a difference in what you are talking aboutand what this piece of legislation is aimed at.

    1. Resolution No. 113 of 2002: A resolution authorizing Mark P. Sealy, located at 7699 West Bert Kouns Industrial Loop, to connect to the water & sewer system of the City of Shreveport and otherwise providing with respect thereto.

    2. Resolution No. 114 of 2002: A resolution authorizing Michael Joe Lewis & Rhonda Cross Lewis, located at 9728 Stonehedge Cir., to connect to the water system of the City of Shreveport and otherwise providing with respect thereto.

      Councilman Carmody: I understand that we are still looking for some information to help the Council determine. . .

      Councilman Burrell: I guess since they are in my area, I am trying to see what, maybe some idea of why we are postponing it. I don't mind, I mean, I don't have a problem with it, kind of give an update on where we are with it.

      Councilman Carmody: I think that we are just checking back with Operational Services as to annexation.

      Councilman Burrell: Oh, okay, that was the issue from prior to. I am with you now.

      Councilman Shyne: I was going to tell you that the next time Mr. Thompson makes up your cheat sheet, makes sure he makes it a little bit clearer here. Mr. Thompson I don't know why you'd do that.

      Councilman Burrell: Do you think they are sabotaging me, Mr. Shyne? Councilman Shyne: I think that is what he is trying to do. Now, why? I don't know.

      Councilman Burrell: I can work through it. I guess I only been here, at this station before, so I can work through it. I appreciate your concern.

    REGULAR AGENDA LEGISLATION:

    RESOLUTIONS:

RESOLUTION NO. 109 OF 2002

A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A COOPERATIVE AGREEMENT IN THE AMOUNT OF $30,000 BETWEEN THE CITY OF SHREVEPORT AND THE LOUISIANA DEPARTMENT OF NATURAL RESOURCES FOR THE IMPLEMENTATION OF A CLEAN CITIES PROGRAM

    WHEREAS, the U. S. Department of Energy (USDOE) has developed an initiative, known as the Clean Cities program, which is intended to develop markets for alternative fuels for motor vehicle fleets throughout the nation, in order to reduce U. S. dependence on foreign oil and to improve air quality;

    WHEREAS, the City of Shreveport is supportive of this initiative and wishes to work toward the introduction of such markets locally, and wishes to participate in the program by working toward designation by the USDOE as a Clean City, which will result in the availability of grant funds to assist in the development of local infrastructure for alternative fuel vehicles;

    WHEREAS, the Louisiana Department of Natural Resources is willing to reimburse the City for costs incurred in implementing a Clean Cities program locally, up to $30,000 over a 2 year period, upon execution of the attached cooperative agreement;

    WHEREAS, the City of Shreveport, along with the City of Bossier City, Caddo Parish, and Bossier Parish, have recently entered into a cooperative endeavor agreement for the sharing of costs associated with air quality improvement programs on a pro rata basis, specifically including the Clean Cities program;

    NOW THEREFORE, BE IT RESOLVED by the City Council of Shreveport, in due, regular and legal session convened, that Keith Hightower, Mayor, be and is hereby authorized to execute on behalf of the City of Shreveport a Cooperative Agreement with the Louisiana Department of Natural Resources for the development of a Clean Cities program for the Greater Shreveport area, in accordance with the terms and conditions contained in the draft of said agreement which was filed for public inspection with the original draft of the resolution in the Office of the Clerk of Council on August 13, 202.

RESOLUTION NO. 115 OF 2002

A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO ADVERTISE A REQUEST FOR PROPOSALS FOR A BANKING SERVICES AGREEMENT AND OTHERWISE PROVIDING WITH RESPECT THERETO.

    BE IT RESOLVED by the City Council of the City of Shreveport in due, legal and regular session convened that the Director of Finance be and she is hereby authorized and instructed to advertise a request for proposals for a banking services agreement for the City of Shreveport, covering the deposit of funds derived from taxes and other revenues for a two year term beginning January 1, 2003, with an option to renew for an additional two year period.

    BE IT FURTHER RESOLVED that the successful proposer shall be required to bind and obligate itself to comply with all requirements provided by law and to meet the City's request for services described in the attached request for proposal for the term agreed on. The deposit of all City funds made pursuant to this agreement shall be protected and secured as provided by law.

    BE IT FURTHER RESOLVED that proposals shall be returnable no later than 2:00 p.m., Tuesday, September 24, 2002 to the Director of Finance in Suite 670, Government Plaza (505 Travis St., Shreveport, Louisiana.) At 3:00 p.m., said proposals will be publicly opened and announced in the City Council meeting in the Government Plaza Chamber located on the first floor of Government Plaza. This resolution shall be promulgated according to law, and banks having local offices shall be notified of the request for proposals.

    BE IT FURTHER RESOLVED that after the proposals are opened and in the case that all are deemed unsatisfactory, the Director is hereby authorized to negotiate a satisfactory banking services agreement with any qualified financial institution. A RESOLUTION SUSPENDING THE EFFECTS OF CERTAIN PROVISIONS OF CHAPTER 10 RELATIVE TO ALCOHOLIC BEVERAGES AND CHAPTER 106 RELATIVE TO ZONING FOR PROPERTYLOCATED AT 6148 BERT KOUNS INDUSTRIAL LOOP EXPRESSWAY FOR A CASTLEBERRY FOUNDATION FUNDRAISER ON OCTOBER 12, 2002, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    WHEREAS, Fud's, located at 6148 Bert Kouns Industrial Loop Expressway, intends to host a Castleberry Foundation fundraiser to benefit Ms. Stephanie Triplet on October 12, 2002; and

    WHEREAS, Fud's desires to dispense, and allow the consumption and sale of alcoholic beverages in the parking lot of the establishment during the fundraiser, between the hours of 1:00 p.m. October 12, 2002, and 2:00 a.m. October 13, 2002; and

    WHEREAS, Section 106-130(6) of the Code of Ordinances provides that unless otherwise excepted, all uses shall be operated entirely within a completely enclosed structure; and

    WHEREAS, the special exception approval granted to the establishment for alcoholic beverage sales, consumption and/or dispensing does not specifically authorize outside sales and/or consumption on the premises; and

    WHEREAS, Section 10-80(a) of the Code of Ordinances makes it unlawful for any person to sell, barter, exchange or otherwise dispose of alcoholic beverages except within those sections of the city wherein such sale is permitted by the applicable zoning ordinance; and

    WHEREAS, Section Chapter 10-103(a)(5) of the Code of Ordinances provides that the city council may suspend or revoke any permit if a retailer allows any person to consume any alcoholic beverage on the licensed premises or on any parking lot or open or closed space within or contiguous to the licensed premises without a proper license; and

    WHEREAS, The Castleberry Foundation is raising money to send Ms. Stephanie Triplet to St. George Hospital in Bad Albling, Germany for a medical procedure that is not available in this country; and

    WHEREAS, the adoption of this resolution would allow the dispensing, sale and consumption of alcoholic beverages on the parking lot of Fud's, 6148 Bert Kouns Industrial Loop Expressway, on October 12, 2002, between the hours of 1:00 p.m. - 2:00 a.m. for a Castleberry Foundation fundraiser.

    NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shreveport in due, legal and regular session convened that Sections 106-130(6), 10-103(a)(5), and 10-80(a) of the Code of Ordinances are hereby suspended on October 12, 2002 from 1:00 p.m. until 2:00 a.m. October 13, 2002, for the Castleberry Foundation fundraiser at Fud's, 6148 Bert Kouns Industrial Loop Expressway.

      Councilman Carmody: I was going to ask if Mr. Strong could come forward. Yesterday during our work session we had asked him to investigate whether or not the remainder of the unused servitude is still in the city's books or have we abandoned the rest of it?

      Councilman Carmody: Let me ask and I know I have talked to a number of property owners which are affected by this servitude which is no longer needed. Could we go ahead and have the Engineering Department determine exactly the extend of what we need to maintain and go ahead and work towards releasing the rest of that?

      Mr. Strong: We can. Normal policy has been if the property owner would advise of it and then we would go forth but we can look at it and come back to the City. Because we have not actively gone out on some of the easements due to the fact that it should be made, come back and have to use it later on, but if a property owner request it and we have no use at the time, we will do it.

      Councilman Carmody: I will contact the property owner that has made me aware of the situation and ask him to make that request to the City.

    WHEREAS, the Shreveport Airport Authority, acquired property under the Airport Authority Noise Mitigation Program; and

    WHEREAS, the property was declared surplus property by the Airport Authority commission; and

    WHEREAS, the property that resides on this lot must be removed with the stipulation that the lot be returned to green space; and

    WHEREAS, Section 18-33 of the Shreveport Code of Ordinances provides that the City Council has exclusive jurisdiction and authority to authorize alienation of immovable property owned by the Shreveport Airport Authority; and

    WHEREAS, to comply with Federal Aviation Administration (FAA) regulations and grant assurances, the Airport Authority must be compensated from the sale of such property and the funds must be used for airport purposes.

ORDINANCE NO. 119 OF 2002

AN ORDINANCE CLOSING AND ABANDONING A 20 FOOT WIDE SANITARY SEWER SERVITUDE CROSSING A PORTION OF SCOGGINS ISLAND IN SECTIONS 4 AND 5 OF TOWNSHIP 17NORTH, RANGE 13 WEST, CADDO PARISH, LOUISIANA AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    WHEREAS, the City of Shreveport received a 20 foot wide sanitary sewer servitude from property owners crossing a portion of Scoggins Island in March of 1950 as recorded in Book 613, Page 552, of the conveyance records of Caddo Parish; and,

    WHEREAS, today the Property Management Section of the Department of Operational Services has received a request to close and abandon the above identified servitude; and

    WHEREAS, Water and Sewerage Engineering has reviewed this request and has no objections to the 20 wide sanitary sewer servitude being closed and abandoned.

    NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Shreveport in due, legal and regular session convened, that the 20 foot wide sanitary sewer servitude as acquired by the City of Shreveport and recorded in Book 613, Page 552, of the Records and as shown and as indicated on the plat attached hereto and made a part hereof, is hereby closed and abandoned.

    BE IT FURTHER ORDAINED that a certified copy of this ordinance be filed and recorded in the official records of the District Court for Caddo Parish, Louisiana.

AN ORDINANCE TO CREATE AND ESTABLISH A NO PARKING ZONE BETWEEN THE HOURS OF 8:00AM AND 5:00PM MONDAY THROUGH FRIDAY ON THE EAST SIDE OF THE 3400 BLOCK OF DILLINGHAM AVENUE AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

ORDINANCE NO. 121 OF 2002

AN ORDINANCE TO CREATE AND ESTABLISH A NO PARKING ANYTIME ZONE ON THE EAST SIDE OF THE STREET IN FRONT OF 3606 VALLEY VIEW, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    BE IT ORDAINED by the City Council of the City of Shreveport in due, legal and

regular session convened that it shall hereafter be unlawful for anyone to park any vehicle on the east side of the street in front of 3606 Valley View.

    BE IT FURTHER ORDAINED that if any provision of this ordinance or the application thereof is invalid, such invalidity shall not affect other provisions, items or applications of this ordinance which can be given effect without invalid provisions, items or applications and to this end the provisions of this ordinance are hereby declared severable.

    BE IT FURTHER ORDAINED that all ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.

ORDINANCE NO. 122 0F 2002

AN ORDINANCE TO AMEND SECTION 90-3 OF THE CITY OF SHREVEPORT CODE OF ORDINANCES RELATIVE TO TRAFFIC AND VEHICLES AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    BE IT ORDAINED by the City Council of the City of Shreveport in due, regular and legal session convened that Section 90-3 of the Code of Ordinances of the City of Shreveport is hereby amended and now reads as follows:

    Sec. 90-3. Use of roller skates, coasters and similar devices restricted.

    A) No person upon roller skates, or riding in or by means of any coaster, toy vehicle or similar device, shall go upon any roadway, except while crossing a street on a crosswalk and, when so crossing, such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This section shall not apply upon any street while set aside as a play street as authorized by ordinance of the city.

    B) The use of roller skates, roller blades, and skateboards is hereby prohibited in or upon any public street, sidewalk, park, or other public place within the B-4/Central Business District. The prohibition contained herein shall not apply to any portion of the Clyde Fant Bike Trail located within the B-4/ Central Business District.

    C) The first violation of the provisions of this section shall be punished by a fine of $100.00.

    A subsequent violation shall be punished by a fine of $200.00

    BE IT FURTHER ORDAINED that if any provisions or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this ordinance which can be given effect without the invalid provisions, items or applications and to this end, the provisions of this ordinance are hereby declared severable.

    BE IT FURTHER ORDAINED that all ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.

ORDINANCE NO. 123 OF 2002

AN ORDINANCE TO AMEND SECTION 50-204.1 (a) AND (b) OF THE CITY OF SHREVEPORT CODE OF ORDINANCES RELATIVE TO MISCELLANEOUS OFFENSES AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.

    BE IT ORDAINED by the City Council of the City of Shreveport, in due, legal and regular session convened that Section 50-204.1(a) and (b) of the Code of Ordinances of the City of Shreveport are hereby amended and now read as follows:

Sec. 50-204.1. Children of compulsory school age to be in attendance at school; parental duty imposed.

    (A) No child between the ages of seven and 17, inclusive, other than a child that has been suspended or expelled from school shall be at any place within the city limits except in attendance at school between the hours of 8:30 a.m. and 2:30 p.m. during any school day as defined by the Caddo Parish School Board, unless the child has written proof from school authorities excusing him or her from attending school at that particular time, or, unless the child is accompanied by a parent or legal guardian or a responsible adult selected by the parent or legal guardian to supervise the child or is otherwise lawfully excused from being present in school.

    (B) Each parent or legal guardian of a child between the ages of seven and 17, inclusive, shall have a duty to prohibit the child from behaving contrary to subsection (a) of this section. No person shall negligently fail to fulfill the duty imposed by this division.

ORDINANCE NO. 125 OF 2002

AN ORDINANCE AMENDING THE 2002 BUDGET FOR THE RIVERFRONT DEVELOPMENT SPECIAL REVENUE FUND AND OTHERWISE PROVIDING WITH RESPECT THERETO.

    WHEREAS, the City Charter provides for the amendment of any previously-adopted budget; and

    WHEREAS, the City Council finds it necessary to amend the 2002 budget for the Riverfront Development Special Revenue Fund, to appropriate additional funds, shift funds among expenditure categories and for other purposes.

    NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Shreveport, in legal session convened, that Ordinance No. 158 of 2001, the 2002 budget for the Riverfront Development Special Revenue Fund, as amended, be further amended as follows:

In Section 1 (Estimated Receipts):

Increase Estimated Fund Balance as of 1/1/02 by $734,000.

In Section 2 (Appropriations):

Increase Operating Reserves by $704,000.

Increase Transfer to Capital Project Fund by $30,000.

Adjust totals and subtotals accordingly.

    BE IT FURTHER ORDAINED that the remainder of Ordinance No. 158 of 2001, as amended, shall remain unchanged and in full force and effect.

    BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other sections of the ordinance which can be given effect without the invalid provisions, items or applications; and, to this end, the provisions of this ordinance are hereby declared to be severable.
