CC3827 12 29 00 CITY COUNCIL PROCEEDINGS OF THE CITY OF SHREVEPORT, LOUISIANA DECEMBER 27, 2000 The regular meeting of the City Council of the City of Shreveport, State of Louisiana, was called to order by Chairman Joe Shyne at 3:10 p.m.,Wednesday, December 27, 2000, in the Government Chambers in Government Plaza (505 Travis Street). Invocation was given by Dr. Artis Cash. On roll call, the following members were Present: Councilman Huckaby, Stewart (arrived at 3:20), Serio, Spigener, Shyne and Burrell. 6. Absent: Councilman Carmody (out of town). 1. Motion by Councilman Burrell, seconded by Councilman Spigener for approval of the Summary Minutes of the Administrative Conference of December 11, 2000, the Minutes of the Regular Meeting of December 12, 2000 and the Agenda As Amended on December 21, 2000. Motion approved by the following vote: Ayes: Councilmen Huckaby, Spigener, Serio, Shyne and Burrell. 5. Nays: None. Absent: Councilmen Stewart and Carmody. 2. Awards, Recognition of Distinguished Guests and Communications of the Mayor Which Are Required by Law. None. Public Hearings: None. Read by title and as read motion by Councilman Spigener, seconded by Councilman Serio for passage. Councilman Shyne: I believe we still have some more questions pertaining to the budget, this is the Convention. . . . Motion by Councilman Huckaby, seconded by Councilman Burrell to postpone the resolution until the January 9, 2001 meeting. RESOLUTION NO. 204 OF 2000 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SHREVEPORT, CADDO PARISH, LOUISIANA, APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE RECREATIONAL TRAILS PROGRAM AND TO OTHERWISE PROVIDE WITH RESPECT THERETO. WHEREAS, the Transportation Equity Act For the 21st Century ("TEA 21") provides funds to the State of Louisiana for grants to state, local and non-profit organizations to acquire, develop and/or maintain motorized and non-motorized trail purposes; and WHEREAS, the Governor's Office of Rural Development has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures governing project application under the program; and WHEREAS, said procedures established by the Governor's Office of Rural Development require the applicant to certify by resolution the approval of the application before submission of said application. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Shreveport, Caddo Parish, Louisiana hereby: 1. Approves the filing of an application for the Recreational Trails Program; and 2. Certifies that the said applicant has or will have available prior to commencement of any work on the project included in this application, sufficient funds to operate and maintain the project; and 3. Appoint the Mayor as agent of the City of Shreveport to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendments, payment request and so on, which may be necessary for the completion of the aforementioned project. BE IT FURTHER RESOLVED, that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items, and applications of this resolution which can be given effect without the invalid provisions, items, or applications and to this end the provisions of this resolution are hereby declared severable. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed. Absent: Councilmen Stewart and Carmody. 2. INTRODUCTION OF RESOLUTIONS 1. Resolution No. 205 of 2000: A resolution authorizing a contract between the City of Shreveport and Right to Play, Inc. relative to the construction of a handicapped accessible playground at A. C. Steere Park and to otherwise provide with respect thereto. Read by title and as read motion by Councilman Huckaby, seconded by Councilman Burrell for Introduction of the Resolution to lay over until the January 23, 2001 meeting. Motion approved by the following vote: Ayes: Councilmen Huckaby, Serio, Spigener, Shyne and Burrell. 5. Nays: None. Absent: Councilmen Stewart and Carmody. 2. INTRODUCTION OF ORDINANCES: 1. Ordinance No. 221 of 2000: An ordinance to amend Section 62-91 (2) of the Code of Ordinances relative to the Department of Public Assembly and Recreation Fee Schedule and to otherwise provide with respect thereto. 2. Ordinance No. 222 of 2000: An ordinance closing and abandoning a portion of the Meadow Parkway Drive right-of-way in the Meadow Park Heights Subdivision, and to otherwise provide with respect thereto. 3. Ordinance No. 223 of 2000: An ordinance authorizing the lease of city-owned property to Columbia Café' L.L.C. and to otherwise provide with respect thereto. 4. Ordinance No. 224 of 2000: An ordinance amending Chapter 106 of the Code of Ordinances, the City of Shreveport Zoning Ordinance, by rezoning property located generally at the NW corner of E. 70th Street and Fern Avenue Extension, Shreveport, Caddo Parish, Louisiana, from R-A, Residence-Agriculture District to R-1D (PUD), Urban, One Family Residence (Planned Unit Development) District, B-1, Buffer Business District and B-3, Community Business District and to otherwise provide with respect thereto. 5. Ordinance No. 225 of 2000: An ordinance amending Chapter 106 of the Code of Ordinances, the City of Shreveport Zoning Ordinance, by rezoning property located on the north side of College Street, 250 feet east of Line Avenue, Shreveport, Caddo Parish, Louisiana, from R-1H, Urban, One Family Residence District to B-1, Buffer Business District and to otherwise provide with respect thereto. 6. Ordinance No. 226 of 2000: An ordinance amending Chapter 106 of the Code of Ordinances, the City of Shreveport Zoning Ordinance, by rezoning property located 1,500 feet east of Line Avenue, between the Inner Loop and the T & P Railroad tracks, Shreveport, Caddo Parish, Louisiana, from R-3, Urban, Multi-Family Residence District to B-3, Community Business District and to otherwise provide with respect thereto. 7. Ordinance No. 227 of 2000: An ordinance amending Chapter 106 of the Code of Ordinances, the City of Shreveport Zoning Ordinance, by rezoning property located on the east side of Linwood Avenue, 1,000 feet south of the Inner Loop, Shreveport, Caddo Parish, Louisiana, from R-1D, Urban, One-Family Residence District and R-A, Residence Agriculture District to B-3, Community Business District and to otherwise provide with respect thereto. 8. Ordinance No. 228 of 2000: An ordinance amending Chapter 106 of the Code of Ordinances, the City of Shreveport Zoning Ordinance, by rezoning property located on the NW'ly side of Martin Luther King Drive, 675 feet north of Rear Montana, Shreveport, Caddo Parish, Louisiana, from R-1H, Urban, One-Family Residence District to R-1H-E, Urban, One-Family Residence/Extended Use District, "limited to a "senior citizen residential facility, clinic, administration center, and a day care" only, and to otherwise provide with respect thereto. Read by title and as read motion by Councilman Huckaby, seconded by Councilman Spigener for Introduction of the Ordinances to lay over until the January 23, 2001 meeting. Motion approved by the following vote: Ayes: Councilmen Huckaby, Serio, Spigener, Shyne and Burrell. 5. Nays: None. Absent: Councilmen Stewart and Carmody. 2. ORDINANCES ON SECOND READING AND FINAL PASSAGE: 1. Ordinance No. 197 of 2000: An ordinance to repeal Section 2-1 of the Code of Ordinances relative to residency requirements for city officials and to otherwise provide with respect thereto. Having passed first reading on November 14, 2000 was read by title and on motion ordered passed to third reading. Read the third time in full and as read motion by Councilman Burrell, seconded by Councilman Spigener to postpone the ordinance until the January 9, 2001 meeting. Councilman Burrell: The reason why I'm postponing this at this time, is that I'm having the Council office to do some research, some background research, on other city ordinances or should I say other cities that have the same ordinance to get some pros and cons. I think it is so important that a measure of this sort has a lot of significance because it does deal with your top management people who are managing the city and the idea of living outside the city and managing inside of the city. During the holidays, I did have an opportunity to speak with a previous mayor and we had a long conversation about this, as a matter of fact, he approached me about this and he said that he thought that we should have a residency ordinance for those that are in top management. And, the reason that he gave was that when he was mayor, he said that people who worked for the city had a lot of pride in the city and they worked to promote this city and they loved it to the point that they wanted to live in the city. And his words were that, it appears that people now only care to work in the city and not live in the city so you don't have the same type of commitment. And it was good to hear him say that because in order for us to sell Shreveport as if it were our own, I think there is some sense of loyalty that must be there and I think your heart is closer to where you live. And from that standpoint, I felt that it was, I propose to get additional information on other ordinances in other cities that we can discuss this matter more completely and maybe come up with some decision; so, that's the reason behind the postponement at this time. Motion to postpone approved by the following vote: Ayes: Councilmen Huckaby, Stewart, Spigener, Serio, Shyne and Burrell. 6. Nays: None. Absent: Councilman Carmody. 1. 2. Ordinance No. 213 of 2000: An ordinance amending Chapter 106 of the Code of Ordinances, the City of Shreveport Zoning Ordinance, by rezoning property located on the NE corner of Ellerbe Road and Chinquapin Drive, Shreveport, Caddo Parish, Louisiana, from R-1D, Urban, One-Family Residence District to B-2, Neighborhood Business District and to otherwise provide with respect thereto. Having passed first reading on November 28, 2000 was read by title and on motion ordered passed to third reading. Read the third time in full and as read motion by Councilman Serio seconded by Councilman Spigener to postpone the ordinance until the January 9, 2001 meeting. Motion approved by the following vote: Ayes: Councilmen Huckaby, Stewart, Spigener, Serio, Shyne and Burrell. 6. Nays: None. Absent: Councilman Carmody. 1. 3. Ordinance No. 220 of 2000: An ordinance amending Chapter 106 of the Code of Ordinances, the City of Shreveport Zoning Ordinance, by rezoning property located on the NW corner of Shreveport Barksdale Hwy and Knight Street, Shreveport, Caddo Parish, Louisiana, from B-2, Neighborhood Business District to B-3, Community Business District and to otherwise provide with respect thereto. Having passed first reading on December 12, 2000 was read by title and on motion ordered passed to third reading. Read the third time in full and as read motion by Councilman Shyne (Councilman Carmody is not here), seconded by Councilman Stewart to postpone the ordinance until the January 9, 2001meeting. Motion approved by the following vote: Ayes: Councilmen Huckaby, Stewart, Spigener, Serio, Shyne and Burrell. 6. Nays: None. Absent: Councilman Carmody. 1. UNFINISHED BUSINESS (tabled legislation): 1. Ordinance No. 211 of 1998: ZONING: C-64-98, QUERBES LAND CO; N side of E 70th St. between Sand Beach Bayou and Bayou Pierre from R-A to B-2 and B-3, shopping center. (C/Carmody) (Tabled on November 10, 1998 and Postponed on November 24, 1998) 2. Ordinance No. 54 of 1999: Creating a Police Department Citizens' Review Board. (A/Huckaby) (Tabled on August 10, 1999) 3. Ordinance No. 125 of 2000 by Councilman Huckaby: Amending Chapter 10 of the Code of Ordinances by deleting Section 10-144, or its successor provision, relative to physical separation of sales of beverages of high alcoholic content for consumption off the premises. (Tabled on August 22, 2000) 4. Complaint against Express Medical Service: A Class B Ambulance Provider (set time and place of hearing in accordance with Sec. 46-60 of the Code). Councilman Shyne: Do we have our City Attorney here, today? Mayor Hightower: He's not here. Councilman Shyne: Do we have anyone here from the City Attorney's Office that can give us any information, give us an update. Can you give us an update, caught you off guard, on the Express Medical Service? (Ms. Glass' response was inaudible.) NEW BUSINESS: Appeal: BAC-93-00, LAKESHORE BAR-B-Q, 2601 Lakeshore Dr., Unit B; Special Exception Use in a B-2 District; restaurant with on-premises consumption of beer. Motion by Councilman Burrell to postpone the application until the January 9, 2001 meeting, seconded by Councilman Huckaby. Councilman Burrell: The parties associated with this project did meet with the neighborhood association, I did get a call from them, but I haven't talked back to the party in question so we are going to postpone it again. Motion to postpone the application approved by the following vote: Ayes: Councilmen Huckaby, Stewart, Spigener, Serio, Shyne and Burrell. 6. Nays: None. Absent: Councilman Carmody. 1. REPORTS FROM OFFICERS, BOARDS AND COMMITTEES. None. Councilman Shyne: Councilman Stewart, I don't know whether you were here, or Councilman Serio, about the committee we are putting together in order to draw up some guidelines and policies to deal with the naming or re-naming of public property. We've contacted. . . and if you all could get your names in to Lynette, who you would like to serve on that committee at least by next Thursday, we wouldappreciate it. If you would just call Lynette and just give her the name and the telephone number of the people that would be willing to serve on that committee, we would appreciate it. CLERK'S REPORT: (case not to be considered prior to Jan 23.): Letter of Appeal: C-86-00, REALITY INVESTMENTS, INC., 8010 Linwood Ave. from R-D to B-3, self-storage center or other permitted used.
