AN ORDINANCE AMENDING CHAPTER 106 OF THE CODE OF ORDINANCES, THE CITY OF SHREVEPORT ZONING ORDINANCE, BY REZONING PROPERTY LOCATED ON THE NORTH SIDE OF HILRY HUCKABY, 1800’ SOUTH OF NORTH LAKESHORE, SHREVEPORT, CADDO PARISH, LOUISIANA, FROM B-3-E, COMMUNITY BUSINESS/EXTENDED DISTRICT, TO B-3-E, COMMUNITY BUSINESS/EXTENDED USE DISTRICT LIMITED TO “AN OFFICE, EQUIPMENT STORAGE YARD, WITH THE ADDITION OF STOCKPILE MATERIALS (WOOD CHIPS/RECYCLABLE WOOD PRODUCTS“ ONLY, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO

SECTION I: BE IT ORDAINED by the City Council of the City of Shreveport, Caddo Parish, Louisiana, in due, legal and regular session convened, that the zoning classification of property located on the north side of Hilry Huckaby, 1800’ south of North Lakeshore, Shreveport, Caddo Parish, Louisiana, legally described below, be and the same is hereby changed from B-3-E, Community Business/Extended Use District, to B-3-E, Community Business/Extended Use District limited to “ an office, equipment storage yard, with the addition of stockpile materials (wood chips/recyclable wood products) “only,

A tract of land located in Sect. 29, T18N, R14W, Shreveport, Caddo Parish, LA, being all of Government Lots 1, 2, 4, 5, 6, 7, and 10, lying north of the Shreveport-Blanchard Hwy less and except that tract particularly described as: Begin at the NW corner of Sect. 29, T18N, R14W, Caddo Parish, LA, measure N89˚54’E along the north line of Sect. 29 for a distance of 1010 feet, M/L, to the POB.From the POB continue along the north line of Sect. 29 N89˚54’E a distance of 1660 feet M/L to the NE corner of Government Lot 1; thence south along said east line of said lot for a distance of 1325 feet M/L to the SE corner of Lot 1; thence east along the north line of Lot 7 a distance of 1335 feet M/L to the NE corner of Lot 7, thence south along the east line of Lot 7 a distance of 765 feet M/L to the SE corner of Lot 7 and on the north line of Lot 10; thence east along the north line of Lot 10 a distance of 50 feet M/L to the NE corner of Lot 10; thence south along the east line of Lot 10 a distance of 230 feet M/L to the north R/W line of the Shreveport-Blanchard Hwy; thence with said line NW’ly a distance of 2030 feet M/L to the east line of tract sold by Hunter Co. Inc to Southland Broadcasting Co; thence leave said R/W measure along the east line of said tract north a distance of 990 feet M/L to the NE corner of said tract; thence west along the north line of said tract a distance of 500 feet to the NW corner of said tract; thence along the west line of said tract south a distance of 680 feet M/L to the north R/W line of the Shreveport-Blanchard Hwy; thence along said R/W NW’ly a distance of 1310 feet M/L to POB. Tract contains 50 acres M/L.

SECTION II: THAT the rezoning of the property described herein is subject to compliance with the following stipulations:

1. A revised site plan shall be submitted to and approved by the Planning Director, showing screening fence and/or landscaping for a minimum of 100’ up to a maximum of 300’ to shield the equipment from view. Waiver of solid wood screening fence on the remainder of the property that abuts residentially zoned property is granted until such time as the adjacent property is developed residentially. The revised site plan shall also indicate the location of a sign showing contact information.

2. There shall be no on-site burning of debris. The stockpiled material is limited to a maximum height of 10’.

BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this ordinance which can be given effect without the invalid provisions, items, or applications and to this end the provisions of this ordinance are hereby declared severable.

BE IT FURTHER ORDAINED that all ordinances or parts thereof in conflict herewith are hereby repealed.

LOCATION: North side of Hiliry Huckaby III (Shreveport-Blanchard) 1800’ south of North Lakeshore

ZONING: B-3-E Office Equipment storage

PROPOSED: Addition of wood chip disposal and stock pile of materials, with the removal of office use

GENERAL INFORMATION:

• Applicant is requesting the addition of wood chip disposal and stock piling of materials, with a proposed, future office, which is different from the prior B-3-E case which was approved in C-3-05.

• Office for the business is behind the Miller home, in Bossier City.

• Undeveloped land to the north and east is zoned R-A and R1-D. Approximately 30 acres of this site wraps around land which is zoned B-2. Land on the south side of the highway is I-1 and I-2.

• Equipment Yard includes: 2- Cranes 4-1 Ton Utility Trucks: 3- Wood Chippers

2-Bobcats 3-Dump Trucks 6-Utility Trailers

SITE PLAN CONSIDERATIONS:

• Total site is 55+ acres. Approximately 10 acres of this tract will be used.

• The hard surfaced driveway is 12’ wide and 50’ long. It is secured with a 15’ gate.

• The equipment yard is 150’ X 150’. This equipment yard is fenced. The size of the two storage trailers in the enclosed area is 8’ X 18’ and 8’ X 24’. There is 12’ between the two trailers.

• A 5+ acre recycling area is on the west side of the gate. Items included are wood chips, firewood, and logs.

• A 3+ acre area to the east of the gate is for chips, mulch, and stump grinding.

• Future proposed office is 40’ X 40’ and is located between the street and the equipment yard.

• The site is controlled by locked gates to the equipment yard and the front entrance. Surveillance cameras are also in use.

• No screening fence is shown on the street frontage of the site. Applicant is requesting a waiver of the 6’ to 8’ solid screening fence because of the topography of the land.

• Revised site plan has been requested. __

PUBLIC’S ASSESSMENT:

6/4/08: One person spoke in opposition.

7/2/08: Two people spoke in opposition.

BOARD’S DECISION:

6/4/08: The Board voted 7/0 to defer and continue this application to the July 2, 2008 public hearing. The Board strongly encouraged the applicant to install an asphalt driveway within 30 days and to show compliance with the screening of trucks and equipment from the highway within 60 days, consistent with the requirements of the previous approval.

7/2/08: The Board vote 6/0 to recommend approval of B-3-E zoning limited to “an office, equipment storage

yard, with the addition of stockpile materials (wood chips/recyclable wood products)” only, subject to

compliance with the following stipulations:

1. The information stated herein is the result of discussion by a staff review team. The Board members will use all information made available to them in making their decision.

A Planning Commission approval is a use approval only. The applicant is still responsible for complying with all other applicable Zoning Ordinance requirements and obtaining all necessary permits and approvals from other departments or agencies. This shall include, but not be limited to the requirements of the Zoning Administrator, building permits, liquor licenses, the parish health unit, and Certificates of Occupancy.
