PURPOSE
To amend Chapter 42 of the Code of Ordinances to add Article XI relative to operation of a rendering plant or transfer center within the city.

BACKGROUND INFORMATION
The operation of certain businesses within the corporate limits of the City of Shreveport is deemed to have a detrimental impact on public health, welfare and safety. This ordinance would amend Chapter 42 of the Code of Ordinances to add Article XI relative to the operation of a rendering plant or transfer center within the city.

ORDINANCE NO. __________ OF 2008
AN ORDINANCE TO AMEND CHAPTER 42 OF THE CITY OF SHREVEPORT CODE OF ORDINANCES RELATIVE TO OPERATION OF A RENDERING PLANT OR TRANSFER CENTER AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.
BY:
WHEREAS, the operation of certain businesses within the corporate limits of the City of Shreveport is deemed to have a detrimental impact on public health, welfare and safety; and
WHEREAS, Section 2.04 (s) of the Charter authorizes the City to regulate, and if necessary, prohibit “…the exercise of any …offensive or unhealthful business, trade or establishment”.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Shreveport, in due, legal and regular session convened that Chapter 42 of the Code of Ordinances of the City of Shreveport is hereby amended to add thereto Article XI to read as follows:
ARTICLE XI. RENDERING PLANT; TRANSFER CENTER
Sec. 42-346. Definitions.
For the purpose of this article, the following terms shall have the following meanings:
Raw materials means livestock or poultry carcasses and inedible parts thereof, fats, oils, and other inedible animal byproducts, and used fats and oils collected from restaurants or other establishments and intended for use by a rendering plant excluding such materials stored by or on the premises of a restaurant or other establishment lawfully operating within the city limits.
Rendering plant means a building or buildings, the land, machinery, apparatus and fixtures employed in a process by which raw materials are treated, through the use of heat or other methods, so as to convert them into fats and oils, food for poultry, livestock or pets, fertilizer or other products.
Transfer center means a facility or area where raw materials intended for use by a rendering plant are stored or collected.
Sec. 42-347. Rendering Plant; Transfer Center; Prohibition.
It shall be unlawful for any person, persons, firm, partnership, association or corporation to establish or operate a rendering plant or transfer center within the city.

BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this ordinance which can be given effect without the invalid provisions, items or applications and to this end the provisions of this ordinance are hereby declared severable.
BE IT FURTHER ORDAINED that all ordinances or parts thereof in conflict herewith are hereby repealed.
