AN ORDINANCE AMENDING CHAPTER 106 OF THE CODE OF ORDINANCES, THE CITY OF SHREVEPORT ZONING ORDINANCE, BY REZONING PROPERTY LOCATED ON THE EAST SIDE OF YOUREE DRIVE, 350 FEET SOUTH OF EAST KINGS HIGHWAY, SHREVEPORT, CADDO PARISH, LOUISIANA, FROM SPI-3(B-2), COMMERCIAL CORRIDOR OVERLAY (NEIGHBORHOOD BUSINESS) DISTRICT TO B-3, COMMUNITY BUSINESS DISTRICT AND TO OTHERWISE PROVIDE WITH RESPECT THERETO

SECTION I: BE IT ORDAINED by the City Council of the City of Shreveport, Caddo Parish, Louisiana, in due, legal and regular session convened, that the zoning classification of property located on the east side of Youree Drive, 350 feet south of East Kings Highway, Shreveport, Caddo Parish, Louisiana, legally described as Plot 7, Broadmoor Subdivision Unit 1, be and the same is hereby changed from SPI-3(B-2), Commercial Corridor Overlay (Neighborhood Business) District to B-3, Community Business District

SECTION II: THAT the rezoning of the property described herein is subject to compliance with the following stipulations:

    1. Development of the property shall be in substantial accord with the site plan submitted with any significant changes or additions requiring further review and approval by the Planning Commission.

BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this ordinance which can be given effect without the invalid provisions, items, or applications and to this end the provisions of this ordinance are hereby declared severable.

BE IT FURTHER ORDAINED that all ordinances or parts thereof in conflict herewith are hereby repealed.

ZONING: SPI-3 (B-2) to SPI-3 (B-3)

PROPOSED: Retail Shopping Center District:

GENERAL INFORMATION:

    • The applicant is requesting to rezone this property from SPI-3 (B-2) to SPI-3 (B-3) and to obtain site plan approval for this development.

    • Since it’s inception, there has never been a case that changed the base zoning classification in the

SPI-3 District.

    • If this can legally be done, this is a case that would warrant this change as the base zoning splits development into 2 parts.

    • The base zoning in this district is tied to the zoning that was in place when the district was established and the base zoning therefore never changes. This would be the first instance of changing the base zoning.

    • The usually accepted route in order to obtain broader uses than would be allowed under the original base is to apply for an “E” designation.

    • There are no residential uses abutting these lots.

    • Unless these lots are taken out of the SPI-3 District, which has also never been done, the applicant will need to file a variance in the hours of operation in the SPI-3 (B-3) District to operate past 9 P.M.

SITE PLAN CONSIDERATIONS:

    • The new lot has 150 feet if frontage on Youree Drive.

    • The new building will have 3 lease spaces, 1 of which will be a Subway Restaurant.

    • 33 parking spaces are required for the restaurant & 2 additional retail lease spaces; 33 are provided.

    • Landscaping is shown and appears to be in compliance with ordinance standards, but a schedule of plans has not been submitted. This will need to be submitted prior to obtaining a building permit.

    • A “2 column overhead Subway sign is shown to the side of the driveway, but no elevations have been submitted. It is unknown at this time if the signage meets SPI-3 criteria.

PUBLIC’S ASSESSMENT

There was no opposition present.

BOARD’S DECISION

The Board voted 7/0 to recommend approval of the application to rezone the property from SPI-3 (B-2) to B-3 subject to compliance with the following stipulation:

    1. Development of the property shall be in substantial accord with the site plan submitted with any significant changes or additions requiring further review and approval by the Planning Commission.

The information stated herein is the result of discussion by a staff review team. The Board members will use all information made available to them in making their decision.

A Planning Commission approval is a use approval only. The applicant is still responsible for complying with all other applicable Zoning Ordinance requirements and obtaining all necessary permits and approvals from other departments or agencies. This shall include, but not be limited to the requirements of the Zoning Administrator, building permits, liquor licenses, the parish health unit, and Certificates of Occupancy.
