THE CITY COUNCIL REMANDED THIS CASE TO MPC FOR RECONSIDERATION AT THEIR 7-14-09 MEETING.

METROPOLITAN PLANNING COMMISSION

LAND USE REPORT – JUNE 3, 2009

CASE NO: C-34-09: 200 Block of Flournoy-Lucas Road District: D/Wooley

APPLICANT: BRAGG RECREATIONAL CONSULTING INC. District: 9/THibodeaux

LAND OWNER: Stevens Village Properties L.L.C.

LOCATION: NW corner of Flournoy-Lucas Road and I-49

ZONING: R-A to B-3 with MPC approval

PROPOSED: Indoor outdoor amusements or other uses within this zoning classification

GENERAL INFORMATION:

    • Applicant is requesting rezoning of 9.331 acres from R-A to B-3 for an indoor/outdoor amusement center.

    • The property has R-A to the north, and south

    • I-49 is to the east with R-1D across Stevens to the west

    • Applicant requested that the MPC waive the fencing requirement along the north property line as they expect the property to be developed commercially.

SITE PLAN CONSIDERATIONS:

    • The site has 9.331 acres +/- with one building of 17,225 square feet and a small utility building of 400 square feet

    • There will be a miniature golf course; go-kart track and a trampoline and water spray area

    • The main building will house offices, restrooms, arcades and a restaurant with setting area.

    • Parking shown is 106 spaces but due to the nature of the use, actual parking requirements will need to be addressed by the board.

    • Landscaping appears to minimal at best.

ADDITIONAL GENERAL INFORMATION:

    • Based on a request from the Wrenwood Neighborhood Association that the base zoning for this property was B-2, the City Council remanded the case back to the MPC for consideration of B-2-E

    • Subsequent to the City Council remand, MPC staff met with several representatives of the Wrenwood Neighborhood Association.

    • In conduction with a related ZBA case, MPC staff met with neighboring residents of the Wrenwood community. They express the desire to have the zoning limited to B-2 with approval of the extended use of indoor amusements only.

ALTERNATIVES:

A. Recommend approval of the application as submitted subject to compliance with the following stipulation:

1. Development of the property shall be in substantial accord with the site plan submitted with any significant changes or additions requiring further review and approval by the Planning Commission.

2. Development of the property shall begin within a period of two (2) years from the date of the adoption of this ordinance and the failure to comply with such stipulation will cause the rezoning herein described to become null and void, and the zoning classification will automatically revert to _________.

B. Deny the application.

PUBLIC’S ASSESSMENT

6-3-09: 5 people spoke in support.

8-5-09: There was no opposition present.

9-2-09: There was no opposition present.

BOARD’S DECISION

6-3-09: The Board voted 6-0 to grant MPC approval and to recommend approval of the application subject to compliance with the following stipulations:

1. Development of the property shall be in substantial accord with a revised site plan showing a detailed landscaping plan per ordinance standards. Said revised site plan shall be submitted to and approved by the Planning Director, with any significant changes or additions requiring further review and approval by the Planning Commission.

2. Waiver of solid wood screening fence requirement is granted until such time as the adjacent property is developed residentially.

7-14-09: City Council remanded case to the MPC for public hearing.

8-5-09: The Board voted 5-0 to approve the applicant’s request for deferral and continuance to

the September 2, 2009 public hearing.

9/2/09: The Board voted 4-0 to deny the application (the applicant requested withdrawal.) There was one abstaining vote. This application is listed as Ordinance No. 64 of 2009 on the City Council’s agenda.

The information stated herein is the result of discussion by a staff review team. The Board members will use all information made available to them in making their decision.

A Planning Commission approval is a use approval only. The applicant is still responsible for complying with all other applicable Zoning Ordinance requirements and obtaining all necessary permits and approvals from other departments or agencies. This shall include, but not be limited to the requirements of the Zoning Administrator, building permits, liquor licenses, the parish health unit, and Certificates of Occupancy.
