ORDINANCE NO. ____ OF 2009 BY:
SECTION I: BE IT ORDAINED by the City Council of the City of Shreveport, Caddo Parish, Louisiana, in due, legal and regular session convened, that the zoning classification of property located on the northwest corner of Flournoy-Lucas Road and I-49, Shreveport, Caddo Parish, Louisiana, legally described below, be and the same is hereby changed from R-A, Residence/Agriculture District to B-3, Community Business District with MPC approval and legally described as: An 8.90 acre, M/L, tract of land in the NE/4 of Sect. 12, T16N, R14W, Shreveport, Caddo Parish, LA, being more particularly described as: Commence at the NE corner of said Sect. 12 which is monumented with a concrete monument; thence proceed S1˚1’40”W 74.19 feet to the south R/W line of East Bert Kouns Industrial Loop (LA #526); thence proceed S89˚58’12”W along said south R/W line and a projection thereof 2286.49 feet to the W’ly R/W line of I-49 and a ¾ inch iron rod; thence proceed S0˚34’14”W along said W’ly R/W line 195.63 feet to a ¾ inch iron rod; thence proceed S9˚35’22”E along said W’ly R/W line 1068.21 feet to a ¾ inch iron rod; thence proceed S9˚35’23”E along said W’ly R/W line 45.98 feet to the POB of the tract herein described which is monumented with a ¾ inch iron rod; thence proceed S9˚35’23”E along said W’ly R/W 105.06 feet to a ¾ inch iron rod; thence proceed S9˚23’1”E along said W’ly R/W line 406.08 feet to a ¾ inch iron rod; thence proceed S1˚9’12”E along said W’ly R/W line 675.73 feet to the north R/W line of Flournoy Lucas Road and a ¾ inch iron rod; thence proceed N88˚55’18”W along said north R/W line 168.59 feet to a ¾ inch iron rod; thence proceed S81˚36’58”W along said north R/W line 127.66 feet to a ¾ inch iron rod; Thence proceed N1˚7’17”E 948.11 feet to a ¾ inch iron rod; thence proceed N88˚55’18”W 352.02 feet to the east R/W line of Stephens Road and a ¾ inch iron rod; thence proceed N1˚32’1”E along said east R/W line 163.66 feet to a ¾ inch iron rod; thence proceed N7˚57’17”E along said east R/W line 79.72 feet to a ¾ inch iron rod; thence proceed S89˚47’44”E 515.53 feet to the POB of the tract herein described, containing 8.90 acres M/L. SECTION II: THAT the rezoning of the property described herein is subject to compliance with the following stipulations: 1. Development of the property shall be in substantial accord with a revised site plan showing a detailed landscaping plan per ordinance standards. Said revised site plan shall be submitted to and approved by the Planning Director, with any significant changes or additions requiring further review and approval by the Planning Commission. 2. Waiver of solid wood screening fence requirement is granted until such time as the adjacent property is developed residentially. BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this ordinance which can be given effect without the invalid provisions, items, or applications and to this end the provisions of this ordinance are hereby declared severable. BE IT FURTHER ORDAINED that all ordinances or parts thereof in conflict herewith are hereby repealed. C-34-09 Bragg Recreational Consulting Inc METROPOLITAN PLANNING COMMISSION LAND USE REPORT – JUNE 3, 2009 mkr CASE NO: C-34-09: 200 Block of Flournoy-Lucas Road District: D/Wooley APPLICANT: BRAGG RECREATIONAL CONSULTING INC. District: 9/THibodeaux LAND OWNER: Stevens Village Properties L.L.C. LOCATION: NW corner of Flournoy-Lucas Road and I-49 ZONING: R-A to B-3 with MPC approval PROPOSED: Indoor outdoor amusements or other uses within this zoning classification GENERAL INFORMATION: • Applicant is requesting rezoning of 9.331 acres from R-A to B-3 for an indoor/outdoor amusement center. • The property has R-A to the north, and south • I-49 is to the east with R-1D across Stevens to the west • Applicant requested that the MPC waive the fencing requirement along the north property line as they expect the property to be developed commercially. SITE PLAN CONSIDERATIONS: • The site has 9.331 acres +/- with one building of 17,225 square feet and a small utility building of 400 square feet • There will be a miniature golf course; go-kart track and a trampoline and water spray area • The main building will house offices, restrooms, arcades and a restaurant with setting area. • Parking shown is 106 spaces but due to the nature of the use, actual parking requirements will need to be addressed by the board. • Landscaping appears to minimal at best. PUBLIC’S ASSESSMENT 5 people spoke in support. BOARD’S DECISION The Board voted 6-0 to grant MPC approval and to recommend approval of the application subject to compliance with the following stipulations: 1. Development of the property shall be in substantial accord with a revised site plan showing a detailed landscaping plan per ordinance standards. Said revised site plan shall be submitted to and approved by the Planning Director, with any significant changes or additions requiring further review and approval by the Planning Commission. 2. Waiver of solid wood screening fence requirement is granted until such time as the adjacent property is developed residentially. The information stated herein is the result of discussion by a staff review team. The Board members will use all information made available to them in making their decision. A Planning Commission approval is a use approval only. The applicant is still responsible for complying with all other applicable Zoning Ordinance requirements and obtaining all necessary permits and approvals from other departments or agencies. This shall include, but not be limited to the requirements of the Zoning Administrator, building permits, liquor licenses, the parish health unit, and Certificates of Occupancy.
