    PURPOSE

To declare certain adjudicated properties surplus.

This Resolution will have direct impact on Council Districts: A, B, F and G.

    BACKGROUND INFORMATION

Pursuant to the intergovernmental agreement with Caddo Parish, the parish has received applications from persons wishing to purchase adjudicated properties. The Parish will hold an auction for the sale of the properties to the highest bidder, all as provided for in R.S. 47:2201-2211. Section 26-300 of the Code of Ordinances authorizes the Mayor to execute the deed transferring the city’s interest in the property after the City Council has declared the property surplus and that the appropriate procedure has been followed.

COMMUNITY DEVELOPMENT/PROPERTY STANDARDS HAS REVIEWED ALL OF THE PROPERTIES PROPOSED FOR BEING DECLARED SURPLUS AND NO DEMOLITION ORDERS EXIST ON ANY OF THESE PROPERTIES.

In accordance with the intergovernmental agreement, the city will receive its pro rata share of the proceeds of each sale, and will receive future taxes as the properties are returned to the tax rolls.

    RESOLUTION NUMBER ______ OF 2009

    A RESOLUTION DECLARING THE CITY’S INTEREST IN CERTAIN ADJUDICATED PROPERTIES AS SURPLUS AND OTHERWISE PROVIDING WITH RESPECT THERETO.

    WHEREAS, there are numerous parcels of property which have been adjudicated to the City of Shreveport and Caddo Parish for non-payment of ad valorem taxes; and

    WHEREAS, the City of Shreveport has entered into an intergovernmental agreement with Caddo Parish under which Caddo Parish will undertake to sell said properties as authorized in R.S. 47:2201-2211, and

WHEREAS, pursuant to Section 26-300 of the Code of Ordinances, the city’s interests in said properties can be sold after the City Council declares them to be surplus; and

    WHEREAS, the purchasing agent has inquired of all city departments regarding the property described herein and has not received any indication that it is needed for city purposes.

    NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shreveport in due, regular and legal session convened that the following described properties are hereby declared surplus:

    1) Geo.#171416-016-0055 – North 170 ft. of Lot 4, Ewald Annex, Municipal Address – 12381 None, Council District F.

    2) Geo.#181416-001-0373 – 0.59 AC. M/L – SW’LY 55 ft. of Lot 12, Jones-Mabry Subd., Municipal Address – 82985 None, Council District A.

    3) Geo.#181435-029-0019 – Lot 19, Greenlawn Terrace Subd., Municipal Address – 2008 Looney St., Council District A.

    BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof be held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items, or applications, and to this end the provisions of this resolution are hereby declared severable.

    BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.
